President Trump\u2019s lawyers are moving to depose\u00a0Rupert Murdoch,\u00a0and quickly.<\/p>\n\n\n\n
The president\u2019s attorneys in a new court filing Monday said they wish to speak with the conservative media mogul as part of evidence-gathering efforts in connection with Trump\u2019s lawsuit against The Wall Street Journal, citing concerns about Murdoch’s waning health and advanced age. Murdoch is 94 years old.<\/p>\n\n\n\n
This lawsuit arose from\u00a0The Wall Street Journal\u2019s<\/em>\u00a0article<\/a>\u00a0<\/strong>that described an album allegedly compiled by Epstein\u2019s former girlfriend and\u00a0accomplice<\/a>\u00a0Ghislaine Maxwell\u00a0for\u00a0his 50th birthday<\/a>\u00a0in 2003.<\/p>\n\n\n\n According to the report, Trump contributed a letter for the birthday collection that included a\u00a0lewd drawing<\/a>\u00a0and referenced the two men sharing a \u201cwonderful secret.” President Trump has dismissed the letter as fake.<\/p>\n\n\n\n The letter bearing Trump\u2019s name, which was reviewed by the Journal, is crude\u2014like others in the album. It contains several lines of typewritten text framed by the outline of a naked woman, which appears to be hand-drawn with a heavy marker. A pair of small arcs denotes the woman\u2019s breasts, and the future president\u2019s signature is a squiggly \u201cDonald\u201d below her waist, mimicking pubic hair.<\/p>\n<\/blockquote>\n\n\n\n Trump filed the\u00a0complaint<\/a>\u00a0in federal court in Miami earlier this month against the\u00a0Journal<\/em>,\u00a0the\u00a0Journal\u2019s<\/em>\u00a0publishing firm Dow Jones, parent company News Corp, owner Rupert Murdoch, News Corp CEO\u00a0Robert Thomson, and the two\u00a0Journal<\/em>\u00a0reporters, Safdar and Palazzolo. He alleges\u00a0two claims, defamation per se and defamation per quod, and demands $10 billion in damages.<\/p>\n\n\n\n On Monday, Trump filed a\u00a0motion to compel<\/a>\u00a0the expedited deposition\u00a0de bene esse<\/em>\u00a0of Murdoch, a\u00a0de bene esse<\/em>\u00a0deposition is also sometimes called a \u201cpreservation deposition,\u201d and is intended to be taken to preserve testimony for trial.<\/p>\n\n\n\n Law and Crime reports<\/a>:<\/p>\n\n\n\n “[T]here is good cause to expedite Murdoch’s deposition, and the Court should exercise its discretion to authorize the same,” the motion for fast-tracked discovery says.<\/p>\n\n\n\n “Murdoch is 94 years old, has suffered from multiple health issues throughout his life, is believed to have suffered recent significant health scares, and is presumed to live in New York, New York,” wrote Trump lawyer Alejandro Brito. “Taken together, these factors weigh heavily in determining that Murdoch would be unavailable for in-person testimony at trial.”<\/p>\n\n\n\n In the meantime, though, Trump is demanding crucial testimony from the owner of the Journal, whom Trump\u00a0apparently failed to persuade<\/a>\u00a0not to publish the Epstein exclusive in the first place. The plaintiff insists that Murdoch has an “advantage” that Trump does not have, but that the scales would even out were an expedited deposition to occur.<\/p>\n\n\n\n “Murdoch has an advantage over President Trump as Murdoch is able to defend himself because he has access to all the information and documents related to the below-defined malicious and defamatory Article, and the decision behind deciding to publish it,” the motion continued. “On the other hand, President Trump has very limited information related to the Article.
