Gavin Newsom.<\/p>\n\n\n\n<p>U.S. District Judge Karin Immergut ruled the action was unlawful and unconstitutional, issuing an emergency temporary restraining order to halt the deployment of California\u2019s National Guard. The order also bars the use of troops from any other state or Washington, D.C. in Oregon.<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\"><div class=\"wp-block-embed__wrapper\">\n<div class=\"embed-twitter\"><blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\"><p lang=\"en\" dir=\"ltr\">BREAKING: We\u2019re suing Donald Trump.<br><br>His deployment of the California National Guard to Oregon isn\u2019t about crime. <br><br>It\u2019s about power.<br><br>He is using our military as political pawns to build up his own ego.<br><br>It\u2019s appalling. It\u2019s un-American. <br><br>And it must stop. <a href=\"https:\/\/t.co\/jdIMGz8hDP\">pic.twitter.com\/jdIMGz8hDP<\/a><\/p>&mdash; Gavin Newsom (@GavinNewsom) <a href=\"https:\/\/twitter.com\/GavinNewsom\/status\/1974892483994939592?ref_src=twsrc%5Etfw\">October 5, 2025<\/a><\/blockquote><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/div>\n<\/div><\/figure>\n\n\n\n<p>Trump\u2019s move came after a federal judge he appointed temporarily blocked him from deploying 200 Oregon National Guardsmen to Portland, which Newsom pointed out in a second post:<\/p>\n\n\n\n<p>\u201cAfter a federal court blocked his attempt to federalize the Oregon National Guard, Donald Trump is deploying 300 California National Guard personnel into Oregon. They are on their way there now. We are taking this fight back to court. The public cannot stay silent in the face of such reckless and authoritarian conduct by the President of the United States.\u201d<\/p>\n\n\n\n<p>Immergut\u2019s ruling says that the Trump administration\u2019s action violates federal statute 10 U.S.C. \u00a712406 and the Tenth Amendment.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>&#8220;It appears to violate both 10 U.S.C. \u00a712406 and the Tenth Amendment,&#8221; Immergut said during the proceeding, according to reporting from Adam Klasfeld of AllRise News.<\/p>\n<\/blockquote>\n\n\n\n<p>Immergut also pressed\u00a0Justice Department\u00a0attorney Eric Hamilton on why the DOJ continued to pursue troop movements, according to <a href=\"https:\/\/www.foxnews.com\/politics\/federal-judge-blocks-trumps-national-guard-deployment-portland-amid-constitutional-challenge\">Fox News<\/a>.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>&#8220;How could bringing in federalized National Guard from California not be in direct contravention of the TRO that I issued yesterday?&#8221; she asked.<br>&#8220;You\u2019re an officer of the court. Aren\u2019t defendants circumventing my order?&#8221;<\/p>\n\n\n\n<p>Hamilton went on to deny any wrongdoing but did offer a defense to which Immergut pushed back.<\/p>\n\n\n\n<p>&#8220;You have to have a colorable claim that Oregon conditions warrant deploying the National Guard \u2014 you don\u2019t.&#8221;<\/p>\n<\/blockquote>\n\n\n\n<p>Oregon\u2019s Scott Kennedy said it felt like &#8220;a game of rhetorical Whac-A-Mole&#8221; and referenced reports that Trump may be considering sending Texas National Guard troops to Chicago.<\/p>\n\n\n\n<p>DOJ representatives requested a stay, but Immergut denied both the stay and the administrative delay, saying it was an &#8220;emergency&#8221; and there were no new facts to justify the request to change her previous ruling.<\/p>\n\n\n\n<p>&#8220;I\u2019m handling this on an emergency basis with limited briefing,&#8221; she said. &#8220;No new information has been provided about any new issues in Portland.&#8221;<\/p>\n\n\n\n<p>California Gov. Gavin Newsom\u00a0(D) immediately took to X to boast.<\/p>\n\n\n\n<p>&#8220;BREAKING: We just won in court \u2014 again. A federal judge BLOCKED Donald Trump\u2019s unlawful attempt to DEPLOY 300 OF OUR NATIONAL GUARD TROOPS TO PORTLAND. The court granted our request for a Temporary Restraining Order \u2014 HALTING ANY FEDERALIZATION, RELOCATION, OR DEPLOYMENT of ANY GUARD MEMBERS TO OREGON FROM ANY STATE.
