Maurene Comey just scored a courtroom victory \u2014 and it keeps her legal fight against the Trump Justice Department alive.<\/p>\n\n\n\n
A federal judge on Tuesday greenlit the former Manhattan prosecutor\u2019s lawsuit over her sudden firing, rejecting an effort to bury the case inside a government review board.<\/p>\n\n\n\n
The Justice Department had argued Comey needed to take her complaints to the Merit Systems Protection Board \u2014 a little-known agency that handles federal worker disputes. But Comey\u2019s lawyers warned that route would\u2019ve been a dead end.<\/p>\n\n\n\n
U.S. District Judge Jesse Furman wasn\u2019t buying it.<\/p>\n\n\n\n
In a 27-page ruling, the Obama-appointed judge said Comey\u2019s case belongs in federal court because it raises constitutional issues tied to presidential power \u2014 not just a routine workplace dispute.<\/p>\n\n\n\n
\n\u201cThe Court finds that Comey\u2019s claims are not of the type Congress intended to be reviewed within that scheme because it would deprive her of meaningful judicial review, her claims are wholly collateral to the CSRA\u2019s review provisions, and her claims \u2014 which raise fundamental constitutional questions \u2014 fall outside of the MSPB\u2019s traditional expertise,\u201d Furman wrote<\/a>.<\/p>\n<\/blockquote>\n\n\n\n
Fired Without a Word<\/h3>\n\n\n\n
Comey \u2014 a longtime prosecutor in the powerhouse Southern District of New York \u2014 says she was abruptly canned last summer with zero explanation.<\/p>\n\n\n\n
That raised eyebrows inside one of the nation\u2019s most elite U.S. attorney\u2019s offices, where she had spent nearly a decade handling headline-grabbing cases involving Jeffrey Epstein, Ghislaine Maxwell, and Sean \u201cDiddy\u201d Combs.<\/p>\n\n\n\n
But it\u2019s her last name that\u2019s drawing the most attention.<\/p>\n\n\n\n
Comey claims she was fired \u201csolely or substantially because her father is former FBI Director James B. Comey, or because of her perceived political affiliation and beliefs, or both.\u201d<\/p>\n\n\n\n
Her father, of course, is the same James Comey who clashed with Donald Trump and was fired as FBI director in 2017 \u2014 making him a longtime target of Trump allies.<\/p>\n\n\n\n

Judge Furman hinted there may be something to those claims.<\/p>\n\n\n\n
He noted that \u201cin the spring of 2025, prominent supporters of President Trump began to call for her ouster based on that connection,\u201d and that she was terminated shortly thereafter.<\/p>\n\n\n\n
That timeline could become a major battleground as the case moves forward.<\/p>\n\n\n\n

The ruling doesn\u2019t mean Comey wins \u2014 not even close. But it does mean her case won\u2019t be quietly handled behind closed doors.<\/p>\n\n\n\n
Instead, it heads into federal court, where the Justice Department could be forced to explain exactly why she was fired.<\/p>\n\n\n\n
