Prosecutors with the Department of Justice reportedly supported the request.<\/p>\n\n\n\n<p>Judge Flanagan ruled that the North Carolina hearing would be canceled if Comey filed the required waiver by Friday. The \u201c86 47\u201d post was widely seen as a veiled\u2026 <a href=\"https:\/\/t.co\/NUBLcsWKt9\">pic.twitter.com\/NUBLcsWKt9<\/a><\/p>&mdash; Mario Nawfal (@MarioNawfal) <a href=\"https:\/\/twitter.com\/MarioNawfal\/status\/2049271268399006143?ref_src=twsrc%5Etfw\">April 28, 2026<\/a><\/blockquote><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/div>\n<\/div><\/figure>\n\n\n\n<p>According to prosecutors, the phrase \u201c86\u201d is widely understood as slang for eliminating or getting rid of someone, while \u201c47\u201d refers to Trump, the 47th president.<\/p>\n\n\n\n<p>The charging document alleges:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cOn or about May 15, 2025, in the Eastern District of North Carolina, the defendant, JAMES BRIEN COMEY JR, did knowingly and willfully make a threat to take the life of, and to inflict bodily harm upon, the President of the United States, in that he publicly posted a photograph on the internet social media site Instagram which depicted seashells arranged in a pattern making out \u201886 47,\u2019 which a reasonable recipient who is familiar with the circumstances would interpret as a serious expression of an intent to do harm to the President of the United States.\u201d<\/p>\n<\/blockquote>\n\n\n\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\"><div class=\"wp-block-embed__wrapper\">\n<div class=\"embed-twitter\"><blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\"><p lang=\"en\" dir=\"ltr\">\ud83c\uddfa\ud83c\uddf8 Trump unloaded on Comey over the \u201c86 47\u201d seashell post.<br><br>He says \u201c86\u201d is straight mob talk for \u201ckill him,\u201d so \u201c86 47\u201d means kill President Trump.<br><br>Trump not surprisingly called Comey a \u201cDirty Cop\u201d who knows exactly what it means. <a href=\"https:\/\/t.co\/z5gniRxzv5\">https:\/\/t.co\/z5gniRxzv5<\/a> <a href=\"https:\/\/t.co\/QC76J3KxLY\">pic.twitter.com\/QC76J3KxLY<\/a><\/p>&mdash; Mario Nawfal (@MarioNawfal) <a href=\"https:\/\/twitter.com\/MarioNawfal\/status\/2049697625490739688?ref_src=twsrc%5Etfw\">April 30, 2026<\/a><\/blockquote><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/div>\n<\/div><\/figure>\n\n\n\n<p>Comey has fiercely denied the accusations and claimed the prosecution is politically motivated.<\/p>\n\n\n\n<p>When the image was first posted, Comey later said he believed the shells represented a \u201cpolitical message\u201d and claimed he did not realize the numbers could be interpreted as encouraging violence. He eventually deleted the post.<\/p>\n\n\n\n<p>The longtime Trump rival responded to the indictment in a video statement, insisting he has done nothing wrong.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cBut nothing has changed with me. I\u2019m still innocent, I\u2019m still not afraid, and I still believe in the independent federal judiciary, so let\u2019s go,\u201d Comey said.<\/p>\n\n\n\n<p>\u201cBut it\u2019s really important that all of us remember that this is not who we are as a country, this is not how the Department of Justice is supposed to be.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p>The charges \u2014 threatening the president and transmitting a threat in interstate commerce \u2014 each carry a maximum possible prison sentence of five years. Prosecutors would need to prove Comey \u201cknowingly and willfully\u201d threatened to \u201ctake the life of\u201d Trump.<\/p>\n\n\n\n<p>The case marks yet another chapter in the bitter feud between Trump and the former FBI director, whom Trump fired in 2017 during the early stages of the Russia investigation led by former Special Counsel Robert Mueller.<\/p>\n\n\n\n<p>It is also the second criminal case Comey has faced since Trump returned to the White House.<\/p>\n\n\n\n<p>Comey was previously charged with false statements and obstruction tied to his 2020 congressional testimony about FBI leaks.
