Robinson entered not-guilty pleas moments later.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cViewed in the light most favorable to the prosecution, this evidence is sufficient at this stage\u201d to identify Robinson as the alleged gunman, Graf said, according to <a href=\"https:\/\/www.foxnews.com\/us\/tyler-robinson-to-face-trial-charlie-kirk-assassination-judge-keeps-death-penalty-table\" target=\"_blank\" rel=\"noreferrer noopener\">Fox News<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Graf stressed that prosecutors did not have to prove Robinson\u2019s guilt beyond a reasonable doubt during the preliminary hearing. They only needed to establish probable cause.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The higher burden will come at trial.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Judge Rejects Bid To Derail Capital Case<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Robinson\u2019s defense team had pushed the court to block the death penalty, arguing that the single shot that killed Kirk did not place other people at a sufficiently high risk of death to support an aggravated murder charge.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Prosecutors countered that the alleged gunman fired a high-powered rifle from a rooftop more than 400 feet away while thousands of people\u2014including children\u2014were gathered around Kirk.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Graf sided with the state, finding enough evidence to support the aggravating allegation that the attack created a grave risk for others. He also allowed prosecutors to move ahead with their claim that Kirk was deliberately targeted because of his political views.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Prosecutor Ryan McBride told the court that there was a \u201cmountain of evidence\u201d tying Robinson to the killing, including surveillance footage, DNA allegedly recovered from the rifle and messages prosecutors say contained admissions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to the <a href=\"https:\/\/nypost.com\/2026\/09\/01\/us-news\/tyler-robinson-will-go-to-trial-face-possible-death-penalty-for-charlie-kirk-killing-judge-rules\/\" target=\"_blank\" rel=\"noreferrer noopener\">New York Post<\/a>, prosecutors also pointed to a handwritten note in which Robinson allegedly said he had an opportunity to \u201ctake out Charlie Kirk.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Defense attorney Staci Visser argued that the state was stretching Utah\u2019s aggravated murder statute because only one shot was fired and only one person was struck.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Graf ultimately rejected that argument and ordered Robinson to face trial for aggravated murder, felony discharge of a firearm causing serious bodily injury, two counts of obstruction of justice, two counts of witness tampering and committing a violent offense in the presence of a child.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Prosecutors formally announced the seven charges in September 2025, alleging that Robinson planned the attack, concealed the weapon and instructed another person to delete incriminating messages, according to the <a href=\"https:\/\/www.utahcounty.gov\/news\/420\/formal-charges-filed-against-tyler-robinson-in-the-charlie-kirk-shooting-case\" target=\"_blank\" rel=\"noreferrer noopener\">Utah County Attorney\u2019s Office<\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Kirk Family Demands Swift Justice<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Kirk, 31, was fatally shot on Sept. 10, 2025, while speaking before thousands of people at a Turning Point USA event at Utah Valley University in Orem.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Before Tuesday\u2019s hearing concluded, attorney Jeff Neiman, speaking on behalf of Kirk\u2019s family, urged the court to prevent needless delays.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cThe defendant is entitled to a fair trial,\u201d Neiman said. \u201cBut nothing more is owed.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Kirk\u2019s family later called Graf\u2019s ruling \u201can important step\u201d in its pursuit of justice.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cEvery step in this process carries the weight of all that Charlie\u2019s murder has taken,\u201d the family said, pointing especially to Kirk\u2019s children, who will grow up without their father.<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The family said it remains committed to seeking justice while praying for \u201ca transparent and timely process.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Trump Previously Condemned The Assassination<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">President Donald Trump had not issued a verified public response specifically addressing Tuesday\u2019s ruling as of Wednesday morning.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Trump, however, has repeatedly condemned Kirk\u2019s assassination and celebrated his friend and political ally as a martyr for American freedom.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At Kirk\u2019s September 2025 memorial service, Trump called the assassination an attack on the nation\u2019s fundamental liberties and declared that the killer had failed to silence Kirk\u2019s movement.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cThe gun was pointed at him, but the bullet was aimed at all of us,\u201d Trump said, according to the <a href=\"https:\/\/www.whitehouse.gov\/releases\/2025\/09\/president-trump-joins-nation-in-celebrating-charlie-kirks-enduring-legacy\/\" target=\"_blank\" rel=\"noreferrer noopener\">White House<\/a>.<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Robinson is scheduled to return to court on Oct. 23 for a status conference, where Graf could set a trial date.
