{"id":12785,"date":"2026-09-03T10:27:58","date_gmt":"2026-09-03T14:27:58","guid":{"rendered":"https:\/\/greatamericanewsdesk.com\/?p=12785"},"modified":"2026-09-03T10:27:58","modified_gmt":"2026-09-03T14:27:58","slug":"trump-appointed-judge-blocks-doj-bid-to-clear-steve-bannon","status":"publish","type":"post","link":"https:\/\/greatamericanewsdesk.com\/crime\/trump-appointed-judge-blocks-doj-bid-to-clear-steve-bannon\/njackson\/2026\/09\/","title":{"rendered":"Trump-Appointed Judge Blocks DOJ Bid To Clear Steve Bannon"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">A federal judge appointed by President Donald Trump has thrown a temporary roadblock in front of the Justice Department\u2019s effort to erase Steve Bannon\u2019s contempt of Congress case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">U.S. District Judge Carl Nichols declined to dismiss the indictment underlying Bannon\u2019s 2022 conviction, ruling that federal prosecutors failed to provide an adequate explanation for abandoning the case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Justice Department\u2019s request \u201cdoes not explain its motivations for seeking dismissal,\u201d Nichols wrote, according to <a href=\"https:\/\/news.bloomberglaw.com\/us-law-week\/doj-fails-to-get-steve-bannons-contempt-indictment-dismissed\">Bloomberg Law<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nichols said the government must provide \u201ca statement of reasons and underlying factual basis\u201d supporting its request\u2014not merely a broad assertion that dropping the case would serve the interests of justice.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The ruling leaves Bannon\u2019s conviction intact for now, but it does not necessarily represent a lasting defeat. Nichols denied the motion \u201cwithout prejudice,\u201d allowing prosecutors to return with a more detailed justification.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">DOJ\u2019s One-Sentence Explanation Falls Short<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Bannon, who served as Trump\u2019s White House chief strategist during the president\u2019s first term, was convicted on two counts of contempt of Congress after refusing to comply with a subpoena from the House committee that investigated the Jan. 6, 2021, Capitol riot.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The committee sought documents and testimony related to Bannon\u2019s communications with Trump and efforts to challenge the results of the 2020 presidential election.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bannon maintained that he declined to comply after Trump asserted executive privilege. He was nevertheless convicted by a Washington jury in 2022 and served a four-month federal prison sentence in 2024.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After Trump returned to office, the U.S. attorney\u2019s office in Washington moved in February to vacate the judgment and dismiss the indictment with prejudice, which would prevent prosecutors from bringing the same case again.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe government has determined in its prosecutorial discretion that dismissal of this criminal case is in the interests of justice,\u201d prosecutors wrote.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That explanation, signed by U.S. Attorney Jeanine Pirro, did not satisfy Nichols. According to <a href=\"https:\/\/abcnews.com\/US\/judge-declines-dismiss-steve-bannons-criminal-contempt-conviction\/story?id=135988043\">ABC News<\/a>, the judge found that prosecutors had failed to comply with local court rules requiring the government to explain its reasons for seeking dismissal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pirro and Nichols were both appointed by Trump.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Supreme Court Cleared The Path\u2014But Did Not End The Case<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The procedural showdown comes months after the Supreme Court handed Bannon a significant victory in his appeal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In April, the justices vacated the federal appeals court judgment that had upheld Bannon\u2019s conviction and returned the case for further consideration in light of the government\u2019s pending motion to dismiss the indictment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The high court did not directly dismiss Bannon\u2019s charges. Its brief <a href=\"https:\/\/www.supremecourt.gov\/orders\/courtorders\/040626zor_5iek.pdf\">April 6 order<\/a> instead cleared the procedural path for Nichols to consider the Justice Department\u2019s request.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In its Supreme Court filing, the Justice Department argued that Rule 48(a) of the Federal Rules of Criminal Procedure permits prosecutors\u2014with a judge\u2019s approval\u2014to dismiss an indictment even after a jury has returned a guilty verdict and the court has entered judgment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bannon had asked the Supreme Court to examine whether someone \u201cwillfully\u201d defies a congressional subpoena when acting on a good-faith assertion of executive privilege. He also challenged the composition of the House Jan. 6 committee.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Justice Department\u2019s reversal made it unlikely that the justices would reach those broader constitutional questions. Instead, the court vacated the appellate judgment and sent the case back down.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nichols\u2019 latest ruling means the conviction remains on Bannon\u2019s record while prosecutors decide whether to submit a renewed motion with the detailed factual and legal explanation the judge demanded.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Because Bannon has already completed his prison sentence, the immediate consequences are largely symbolic.
