Kelly extended it for \u201canother two business days,\u201d according to <a href=\"https:\/\/thehill.com\/regulation\/court-battles\/6136734-judge-timothy-kelly-briefly-extends-trump-media-ban-block\/\">The Hill<\/a>, with a ruling expected by Tuesday, October 13. TheWrap also reported that Kelly left the request for a preliminary injunction unresolved at Thursday\u2019s hearing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The dispute pits Trump\u2019s claims of false reporting and national security risks against the outlets\u2019 allegations that the president is punishing coverage he dislikes.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">White House Defends Its Restrictions<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The administration has defended the ban by citing national security concerns, anonymous sourcing and reporting it says contains falsehoods.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After imposing the restrictions, the White House sent letters identifying stories it said \u201cthreatened national security and\/or spread falsehoods,\u201d The Hill reported.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Justice Department attorney Michael Velchik argued Thursday that those letters provided sufficient notice and an opportunity for the organizations to respond, even though they declined to do so.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The outlets counter that the explanations came after Trump had already decided to exclude them.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Their attorney, Ted Boutrous, pointed to the president\u2019s recent Time magazine interview as evidence that unfavorable coverage drove the decision. According to The Hill, Boutrous characterized Trump\u2019s comments as a \u201cconfession\u201d of his intent.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The organizations argue that restricting access because of their coverage amounts to unconstitutional viewpoint discrimination.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Judge\u2019s Earlier Ruling Focused On Due Process<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Kelly\u2019s initial order required the administration to restore the organizations\u2019 press credentials. His reasoning focused on whether the White House provided adequate notice and an opportunity to challenge the restrictions before imposing them.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He found that the outlets were likely to succeed on their constitutional due process claim. He did not resolve their separate First Amendment arguments.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As TheWrap reported, Kelly initially blocked the ban on September 24 and questioned whether the administration had supplied sufficient evidence for its national security justification. Thursday\u2019s extension keeps temporary protections in place while the broader legal fight continues.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Air Force One Access Remains A Flashpoint<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Restoring press credentials has not ended the confrontation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">CNN and Politico have been excluded from Air Force One trips since Kelly\u2019s initial ruling, according to The Hill and <a href=\"https:\/\/www.mediaite.com\/media\/news\/cnn-ms-now-and-politico-keep-access-to-white-house-for-now\/\" target=\"_blank\" rel=\"noreferrer noopener\">Mediaite<\/a>. The outlets contend that those restrictions undermine their ability to cover the president and fulfill their assigned press pool duties.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The pool is a rotating group of journalists that covers presidential activities and shares reporting with other news organizations.
