Kathy Hochul\u2019s decision to appoint her as special prosecutor.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cAnd I feel badly for whoever she\u2019s looking at because they won\u2019t get a fair shake,\u201d Trump added, according to <a href=\"https:\/\/www.foxnews.com\/politics\/tish-james-confronted-camera-trumps-accusation-bias-cornell-rape-case\">Fox News<\/a>.<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">James\u2019 response: Her office will follow the evidence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Speaking to a reporter Friday, October 16, she pledged a fair investigation. During a campaign debate, she also rejected claims that she had already made up her mind, saying \u201cpolitics stops at the door\u201d of her office, Fox News reported.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The Post Behind The Fight<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Trump isn\u2019t the only person questioning James\u2019 impartiality.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Lawyers for two men named in the underlying civil lawsuit \u2014 Gillio Lopes and Winston Lee \u2014 have sought her removal. Their objections focus on a social media message James published before receiving the special prosecutor assignment.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cWhat this young woman has been forced to endure is horrific and unacceptable,\u201d James wrote September 28.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cTo her, and to all survivors: you\u2019re not alone. We stand with you.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Defense attorneys argue that those words signal she accepted the allegations before conducting the investigation. James has characterized the message as an expression of \u201cempathy,\u201d according to Fox News.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www-cdn.abcnews.com\/US\/accused-cornell-fraternity-member-pushes-remove-new-york\/story?id=137085434\">ABC News reported<\/a> that Lopes\u2019 attorney formally asked a court to overturn her appointment. Doe\u2019s attorney, Thomas Giuffra, has rejected defense arguments challenging her account as self-serving. The accused men deny wrongdoing.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Hochul Stands By Her Pick<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The case stems from allegations that a woman identified as Jane Doe was sexually assaulted by seven men at Cornell\u2019s Chi Phi fraternity house in October 2024.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Local prosecutors initially declined to pursue charges. Cornell\u2019s separate disciplinary investigation resulted in two expulsions and two suspensions, Fox News reported.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Hochul appointed James on October 1 after raising concerns about the original investigation.
