{"id":1403,"date":"2022-12-12T16:12:38","date_gmt":"2022-12-12T16:12:38","guid":{"rendered":"https:\/\/greatamericanewsdesk.com\/?p=1403"},"modified":"2022-12-12T16:40:38","modified_gmt":"2022-12-12T16:40:38","slug":"trump-special-master-request-rescinded-report","status":"publish","type":"post","link":"https:\/\/greatamericanewsdesk.com\/news\/trump-special-master-request-rescinded-report\/njackson\/2022\/12\/","title":{"rendered":"Trump Special Master Request Rescinded: Report"},"content":{"rendered":"\n<p>The federal judge in Florida who initially granted former President Donald Trump&#8217;s special master request has dismissed his lawsuit, marking a sudden end to the monthslong chronicle since the FBI&#8217;s search of Trump&#8217;s residence.<\/p>\n\n\n\n<p>Following the FBI&#8217;s unprecedented search of Trump&#8217;s Mar-a-Lago estate, the former president requested a third party to oversee the Justice Department&#8217;s investigation into the documents seized from the Florida estate.<\/p>\n\n\n\n<p>On Monday, U.S. District Judge\u00a0Aileen Cannon, an appointee of the former president, affirmed an appeals court&#8217;s decision that she lacked jurisdiction to appoint a special master to oversee documents taken from his estate and lifted an injunction that blocked investigators from using them in a criminal investigation in the meantime.<\/p>\n\n\n\n<p>By dismissing the lawsuit, titled\u00a0<em>Trump v. United States<\/em>, all scheduled hearings over the dispute in the U.S. District Court for the Southern District of Florida are canceled, and all pending motions are &#8220;denied as moot,&#8221;\u00a0<a href=\"https:\/\/www.courtlistener.com\/docket\/64911367\/199\/trump-v-united-states\/\" target=\"_blank\" rel=\"noreferrer noopener\">according<\/a>\u00a0to a court order.<\/p>\n\n\n\n<div data-wp-interactive=\"core\/file\" class=\"wp-block-file\"><object data-wp-bind--hidden=\"!state.hasPdfPreview\" hidden class=\"wp-block-file__embed\" data=\"https:\/\/greatamericanewsdesk.com\/wp-content\/uploads\/2022\/12\/gov.uscourts.flsd_.618763.199.0.pdf\" type=\"application\/pdf\" style=\"width:100%;height:600px\" aria-label=\"Embed of gov.uscourts.flsd_.618763.199.0.\"><\/object><a id=\"wp-block-file--media-8b04913b-a3c2-486c-ba50-678140cd60fd\" href=\"https:\/\/greatamericanewsdesk.com\/wp-content\/uploads\/2022\/12\/gov.uscourts.flsd_.618763.199.0.pdf\">gov.uscourts.flsd_.618763.199.0<\/a><a href=\"https:\/\/greatamericanewsdesk.com\/wp-content\/uploads\/2022\/12\/gov.uscourts.flsd_.618763.199.0.pdf\" class=\"wp-block-file__button wp-element-button\" download aria-describedby=\"wp-block-file--media-8b04913b-a3c2-486c-ba50-678140cd60fd\">Download<\/a><\/div>\n\n\n\n<p><em>The Washington Examiner<\/em> <a href=\"https:\/\/www.washingtonexaminer.com\/policy\/courts\/trump-special-master-mar-a-lago-dismissed\" target=\"_blank\" rel=\"noreferrer noopener\">reports<\/a>:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>Earlier this month, the U.S. Court of Appeals for the 11th Circuit ruled that Cannon&nbsp;<a href=\"https:\/\/www.washingtonexaminer.com\/policy\/courts\/trump-special-master-mar-a-lago-dismissed\" target=\"_blank\" rel=\"noreferrer noopener\">never<\/a>&nbsp;had the jurisdiction to assign U.S. District Senior Judge Raymond Dearie, a semiretired jurist based in Brooklyn, to serve the role of the special master.<\/p>\n\n\n\n<p>&#8220;We cannot write a rule that allows any subject of a search warrant to block government investigations after the execution of the warrant,&#8221; Judge William Pryor, an appointee of George W. Bush, wrote for a unanimous panel ruling. &#8220;Nor can we write a rule that allows only former presidents to do so. Either approach would be a radical reordering of our caselaw limiting the federal courts&#8217; involvement in criminal investigations. And both would violate bedrock separation-of-powers limitations.&#8221;<\/p>\n\n\n\n<p>Dearie had expected to complete his review by Friday. The 11th Circuit&#8217;s decision came less than two weeks after Attorney General Merrick Garland appointed special counsel Jack Smith to oversee the investigation into Trump&#8217;s efforts to overturn the 2020 election and the unauthorized transfer of about 100 classified documents to Mar-a-Lago after he left the Oval Office.<\/p>\n<\/blockquote>\n\n\n\n<p><strong><em>This story is developing.
