Is the highly anticipated Fox News<\/a> trial finished before it even started?<\/p>\n\n\n\n

Hours before the trial was set to begin, a Delaware judge announced late Sunday he would delay the beginning of Dominion Voting Systems\u2019 defamation lawsuit against Fox News by 24 hours.<\/p>\n\n\n\n

\u201cThe Court has decided to continue the start of the trial, including jury selection, until Tuesday, April 18, 2023 at 9:00 a.m.,\u201d Superior Court Judge Eric Davis said<\/a> in a statement.<\/p>\n\n\n\n

A trial in the case had been slated to start Monday morning. Numerous high-profile Fox News officials including Chairman Rupert Murdoch, CEO Suzanne Scott, Tucker Carlson, and Maria Bartiromo are scheduled to take the stand. <\/p>\n\n\n\n

Dominion Voting Systems\u00a0filed a $1.6 billion lawsuit in 2021 following the presidential election. The company argues\u00a0Fox News’ airing of claims of voter fraud propagated by former President\u00a0Donald Trump<\/a>\u00a0<\/a>and his allies defamed the company and caused irreparable damage to its credibility.<\/p>\n\n\n\n

Fox has fiercely defended itself on First Amendment<\/a> grounds and has argued the network was covering the allegations being made by the then-President because they were newsworthy.<\/p>\n\n\n\n

\u201cThis case is and always has been about the\u00a0First Amendment<\/a>\u00a0protections of the\u00a0media’s absolute right to cover the news,\u201d Fox said in a recent statement about the case. \u201cFox will continue to fiercely advocate for the rights of\u00a0free speech\u00a0and a free press as we move into the next phase of these proceedings.\u201d\u00a0<\/p>\n\n\n\n

While it remains unclear what exactly triggered the delay in proceedings CNN senior analyst Elie Honig predicted<\/a> that extra time would allow for a potential settlement. <\/p>\n\n\n\n

On CNN This Morning<\/em>, Honig called this \u201cthe most likely scenario\u201d for the Dominion trial before adding, \u201cthere\u2019s something about being on the eve of trial that can really sober up both parties.\u201d<\/p>\n\n\n\n

\u201cLook at it from Fox\u2019s point of view: they\u2019re looking at the likelihood \u2014 if there\u2019s a trial \u2014 of having all of their, or many of their, most prominent anchors have to take the stand, testify and get cross-examined,\u201d Honig said. \u201cYou can understand why they would be hit by reality at the last moment, say, \u2018We need to avoid this.’\u201d<\/p>\n\n\n\n

\u201cKeep in mind, the judge here has already made a finding \u2014 as a matter of law \u2014 that Fox\u2019s statements about the 2020 election and about Dominion were false. So that is on the record,\u201d Honig said. \u201cThe only question at trial was going to be is there actual malice? Did Fox know, or were they reckless about the falsity?\u201d<\/p>\n<\/blockquote>\n\n\n\n

However, Honig conceded \u201cyou never really know\u201d what the jury could decide if the trial ultimately happens.<\/p>\n\n\n\n

In an early morning Truth Social post, Donald Trump called on the network to to \u201cadmit\u201d the 2020 election was effectively stolen from him.<\/p>\n\n\n\n
