{"id":5125,"date":"2023-09-08T16:37:47","date_gmt":"2023-09-08T20:37:47","guid":{"rendered":"https:\/\/greatamericanewsdesk.com\/?p=5125"},"modified":"2023-09-08T16:37:48","modified_gmt":"2023-09-08T20:37:48","slug":"court-rules-in-favor-of-controversial-texas-border-barrier","status":"publish","type":"post","link":"https:\/\/greatamericanewsdesk.com\/news\/court-rules-in-favor-of-controversial-texas-border-barrier\/njackson\/2023\/09\/","title":{"rendered":"Court Rules in Favor of Controversial Texas Border Barrier"},"content":{"rendered":"\n<p>The Fifth Court of Appeals ruled in favor of Texas&#8217; floating border barrier on Thursday, dealing a blow to the Biden administration and pro-immigration groups.<\/p>\n\n\n\n<p>Senior U.S. District Court Judge David Ezra originally ordered Texas officials to remove the floating barriers from the river that Governor\u00a0Greg Abbott\u00a0(R-TX) had installed before the Appeals Court granted a motion from Texas.<\/p>\n\n\n\n<p>Abbott\u2019s legal team\u00a0<a href=\"https:\/\/www.axios.com\/2023\/09\/08\/texas-floating-border-barrier-stay-appeals-court\">said<\/a>\u00a0on Thursday that \u201cbuoys have nearly eliminated illegal crossings of people and drugs where they\u2019ve been placed.\u201d<\/p>\n\n\n\n<p><a href=\"https:\/\/www.dailywire.com\/news\/court-allows-texas-water-border-barrier-targeted-by-biden-admin-to-stay-in-place\">The Daily Wire<\/a> has more:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>Ezra\u2019s order followed the Department of Justice suing Texas over the barrier, citing environmental and humanitarian concerns. Ezra, a Reagan appointee, said Texas\u2019 actions had violated the Rivers and Harbors Act (RHA) of 1899.&nbsp;<\/p>\n\n\n\n<p>\u201cThe Court finds that the barrier\u2019s threat to human life, its impairment to free and safe navigation, and its contraindication to the balance of priorities Congress struck in the RHA outweigh Texas\u2019s interest in implementing its buoy barrier in the Rio Grande River,\u201d the judge&nbsp;<a href=\"https:\/\/www.theepochtimes.com\/us\/texas-wins-appeal-to-keep-floating-barrier-in-rio-grande-to-deter-illegal-crossings-5488144?ea_src=frontpage&amp;ea_med=top-news-15\" target=\"_blank\" rel=\"noreferrer noopener\">wrote<\/a>. \u201cThe harm to navigation is clearly evident from the evidence presented, while the State of Texas did not present any credible evidence that the buoy barrier as installed has significantly curtailed illegal immigration across the Rio Grande River.\u201d<\/p>\n\n\n\n<p>Abbott argued that Ezra\u2019s ruling was wrong and vowed that Texas would challenge it.&nbsp;<\/p>\n\n\n\n<p>\u201cThis ruling is incorrect and will be overturned on appeal,\u201d Abbott&nbsp;<a href=\"https:\/\/www.cbsnews.com\/news\/texas-border-barriers-buoys-removed-federal-judge-biden-administration\/\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a>&nbsp;in a statement. \u201cWe will continue to utilize every strategy to secure the border, including deploying Texas National Guard soldiers and Department of Public Safety troopers and installing strategic barriers.\u201d<\/p>\n<\/blockquote>\n","protected":false},"excerpt":{"rendered":"<p>The Fifth Court of Appeals ruled in favor of Texas&#8217; floating border barrier on Thursday, dealing a blow to the Biden administration and pro-immigration groups.
