Election Interference Case"},"content":{"rendered":"\n<p>Former President Trump attempted to distance himself from the January 6, 2021, attack on the Capitol in a series of late-night legal motions.<\/p>\n\n\n\n<p>Former President Trump\u2019s legal team is asking a judge to toss his prosecution in his federal election interference case.<\/p>\n\n\n\n<p><a href=\"https:\/\/www.thedailybeast.com\/trump-files-4-late-night-motions-in-one-hour-over-dc-2020-election-case?ref=home\">The Daily Beast<\/a> reports that in one motion, Trump filed to\u00a0<a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.258149\/gov.uscourts.dcd.258149.113.0_1.pdf\">dismiss<\/a>\u00a0his federal 2020 election subversion case, citing First Amendment rights surrounding Trump\u2019s belief the election as stolen and claiming the indictment, \u201ctaken as true, violates this core principle.\u201d <\/p>\n\n\n\n<p>\u201cThe fact that the indictment alleges that the speech at issue was supposedly, according to the prosecution, \u2018false\u2019 makes no difference,\u201d the defense wrote. \u201cUnder the First Amendment, each individual American participating in a free marketplace of ideas \u2014 not the federal Government \u2014 decides for him or herself what is true and false on great disputed social and political questions.\u201d<\/p>\n\n\n\n<p>\u201cPresident Trump\u2019s opinion on the subject was just that \u2014 an opinion formed based on his view of the available information. Virtually every American, including the cited public officials, had similar access to much of this same information, including a mountain of publicly reported facts and opinions, which were the subject of wall-to-wall media coverage throughout the post-election period and beyond,\u201d they wrote.<\/p>\n\n\n\n<p>\u201cEach official thus had every opportunity to form his or her own conclusions, just like President Trump.\u201d<\/p>\n\n\n\n<p>The\u00a0<a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.258149\/gov.uscourts.dcd.258149.114.0_2.pdf\">second motion<\/a>\u00a0seeks dismissal on statutory grounds, arguing, \u201cThe prosecution does not explain how President Trump violated these statutes, beyond simply saying he has while regurgitating the statutory language.\u201d <\/p>\n\n\n\n<p>The third\u00a0<a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.258149\/gov.uscourts.dcd.258149.115.0.pdf\">motion<\/a>\u00a0asks Judge Chutkan to remove \u201crepeated references to the actions of independent actors at the Capitol on January 6, 2021\u201d from his indictment, claiming Trump was not charged \u201cwith responsibility for the actions at the Capitol\u201d and therefore the \u201callegations related to these actions are not relevant and are prejudicial and inflammatory.\u201d <\/p>\n\n\n\n<p>\u201cBecause the Government has not charged President Trump with responsibility for the actions at the Capitol on January 6, 2021, allegations related to these actions are not relevant and are prejudicial and inflammatory. Therefore, the Court should strike these allegations from the Indictment,\u201d his attorneys wrote in a motion to strike \u201cinflammatory allegations\u201d from Trump\u2019s indictment.\u00a0<\/p>\n\n\n\n<p>The\u00a0<a href=\"https:\/\/www.documentcloud.org\/documents\/24077013-mtd-selective-prosecution\">fourth<\/a>\u00a0saw Trump request dismissal \u201con the basis of selective and vindictive prosecution.\u201d<\/p>\n\n\n\n<p>\u201cThese demands place an unacceptable burden on President Trump to foreshadow a possible formal defense,\u201d they wrote.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Former President Trump attempted to distance himself from the January 6, 2021, attack on the Capitol in a series of late-night legal motions.
