{"id":5740,"date":"2023-12-15T10:08:27","date_gmt":"2023-12-15T15:08:27","guid":{"rendered":"https:\/\/greatamericanewsdesk.com\/?p=5740"},"modified":"2023-12-18T11:21:05","modified_gmt":"2023-12-18T16:21:05","slug":"michigan-appeals-court-rules-on-trump-ballot-challenge","status":"publish","type":"post","link":"https:\/\/greatamericanewsdesk.com\/news\/michigan-appeals-court-rules-on-trump-ballot-challenge\/njackson\/2023\/12\/","title":{"rendered":"Michigan Appeals Court Rules On Trump Ballot Challenge"},"content":{"rendered":"\n<p>On Thursday, the Michigan Court of Appeals sided with former President Donald Trump, ruling the Republican candidate can appear on the state&#8217;s primary ballot.<\/p>\n\n\n\n<p>While the appeals court upheld two lower court decisions the Court declined to decide whether Trump should be disqualified under the 14th Amendment, which bars those who previously took an oath to uphold the Constitution but later \u201cengaged in insurrection\u201d from holding office again.<\/p>\n\n\n\n<p><a href=\"https:\/\/thehill.com\/regulation\/court-battles\/4361894-michigan-court-trump-2024-primary\/\">The Hill<\/a> has more: <\/p>\n\n\n\n<p>The court determined that the former president\u2019s spot on the general election ballot was not ripe for consideration.&nbsp;<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cIt would be improper to decide whether to grant a declaration that Trump is disqualified from holding the office of President of the United States at this time,\u201d the 3-0 opinion reads. \u201cAt the moment, the only event about to occur is the presidential primary election.\u201d<\/p>\n\n\n\n<p>Regarding his spot on Michigan\u2019s primary ballot, the secretary of state has \u201cno discretion\u201d to decide not to place him \u2014 or any other candidate identified as a primary candidate by a state political party \u2014 on the ballot.<\/p>\n<\/blockquote>\n\n\n\n<p><em>This is a breaking news story.
