It is subject to further appellate proceedings.<\/p>\n\n\n\n<p>An appeal is all but certain, as CNBC&nbsp;<a href=\"https:\/\/www.cnbc.com\/2023\/12\/19\/trump-ballot-challenge-decided-by-colorado-supreme-court.html#:~:text=The%20decision%20is%20the%20first,%E2%80%9Cinsurrection%E2%80%9D%20from%20federal%20office.\" target=\"_blank\" rel=\"noreferrer noopener\">reports<\/a>:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><em>The ruling is the first time a state court has agreed that Trump, who is the front-runner for the Republican presidential nomination, should be barred from ballots in a state because of a U.S. constitutional provision barring people who have engaged in \u201cinsurrection\u201d from federal office.<\/em><\/p>\n<\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><em>Courts in Minnesota and Michigan have rejected similar suits challenging Trump&#8217;s placement on the presidential ballot, but the issue is continuing to be litigated in a number of states.<\/em><\/p>\n\n\n\n<p><em>A group of six Colorado&nbsp;<a href=\"https:\/\/www.nbcnews.com\/politics\/2024-election\/six-colorado-voters-file-lawsuit-remove-trump-states-2024-ballot-rcna103660\" target=\"_blank\" rel=\"noreferrer noopener\">voters<\/a>&nbsp;in September sued to block Trump from state ballots in 2024 because of a claim he was barred due to a provision in the 14th Amendment of the U.S. Constitution.<\/em><\/p>\n\n\n\n<p><em>That provision, Section 3, says that \u201cno person\u201d can serve as an officer of the&nbsp;<a href=\"https:\/\/americanliberty.news\/tag\/united-states\/\">United States<\/a>&nbsp;who, having previously taken an oath of federal office, \u201cengaged in insurrection or rebellion\u201d against the U.S.<\/em><\/p>\n<\/blockquote>\n\n\n\n<p>A&nbsp;Colorado&nbsp;judge ruled last month that Trump&nbsp;must be allowed on next year&#8217;s Republican primary ballot. District Judge&nbsp;Sarah Wallace&nbsp;said in her ruling that that language in the&nbsp;<a href=\"https:\/\/americanliberty.news\/tag\/14th-amendment\/\" target=\"_blank\" rel=\"noreferrer noopener\">14<sup>th<\/sup>&nbsp;Amendment<\/a>&nbsp;means it can&#8217;t be used to prevent Trump from appearing on the ballot.<\/p>\n\n\n\n<p>Citizens for Responsibility and Ethics in&nbsp;<a href=\"https:\/\/americanliberty.news\/tag\/washington\/\">Washington<\/a>&nbsp;(CREW), which filed the lawsuit on behalf of six Colorado voters, appealed Wallace&#8217;s decision to the Colorado Supreme Court.<\/p>\n\n\n\n<p>The disqualification trial focused on Trump&#8217;s actions before and during the U.S.&nbsp;<a href=\"https:\/\/americanliberty.news\/tag\/capitol-riot\/\">Capitol riot<\/a>&nbsp;and whether they violated Section 3 of the 14<sup>th<\/sup>&nbsp;Amendment. Section 3 states:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><em>No person shall be a Senator or Representative in&nbsp;<\/em><a href=\"https:\/\/americanliberty.news\/tag\/congress\/\">Congress<\/a><em>, or elector of President and Vice-President, or hold any office, civil or military, under the&nbsp;<\/em><a href=\"https:\/\/americanliberty.news\/tag\/united-states\/\">United States<\/a><em>, or under any State, who, having previously taken an oath, as a member of&nbsp;<a href=\"https:\/\/americanliberty.news\/tag\/congress\/\">Congress<\/a>, or as an officer of the&nbsp;<\/em><a href=\"https:\/\/americanliberty.news\/tag\/united-states\/\">United States<\/a><em>, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof.
