{"id":6250,"date":"2024-02-29T12:08:47","date_gmt":"2024-02-29T17:08:47","guid":{"rendered":"https:\/\/greatamericanewsdesk.com\/?p=6250"},"modified":"2024-02-29T12:08:48","modified_gmt":"2024-02-29T17:08:48","slug":"supreme-court-takes-up-trump-immunity-claim","status":"publish","type":"post","link":"https:\/\/greatamericanewsdesk.com\/featured\/supreme-court-takes-up-trump-immunity-claim\/njackson\/2024\/02\/","title":{"rendered":"Supreme Court Takes Up Trump Immunity\u00a0Claim"},"content":{"rendered":"\n<p>On Wednesday, the U.S. Supreme Court announced it will take up the issue of whether former President\u00a0Donald Trump\u00a0can invoke presidential immunity to shield himself from federal prosecution.<\/p>\n\n\n\n<p>The high court\u00a0<a href=\"https:\/\/www.supremecourt.gov\/search.aspx?filename=\/docket\/docketfiles\/html\/public\/23a745.html\" target=\"_blank\" rel=\"noreferrer noopener\">scheduled<\/a>\u00a0an oral argument for the week of April 22, 2024.<\/p>\n\n\n\n<p>The high Court&#8217;s decision comes after a U.S. Court of Appeals for the District of Columbia Circuit panel\u00a0<a href=\"https:\/\/www.dailywire.com\/news\/appeals-court-denies-trumps-immunity-claim-in-2020-election-interference-case\" target=\"_blank\" rel=\"noreferrer noopener\">ruled against<\/a>\u00a0the immunity claim in the 2020 election case against Trump brought by special counsel\u00a0Jack Smith.<\/p>\n\n\n\n<p><a href=\"https:\/\/www.dailywire.com\/news\/supreme-court-takes-up-trump-immunity-claim\" target=\"_blank\" rel=\"noreferrer noopener\">The Daily Wire<\/a> has more:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>Andrew Weissmann, a former federal prosecutor who worked in special counsel Robert Mueller\u2019s Russia inquiry into Trump,&nbsp;<a href=\"https:\/\/twitter.com\/AWeissmann_\/status\/1762965590245822531\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a>,&nbsp;\u201cThe SCOTUS stays DC case and expedites hearing the Trump appeal on immunity. But every day of delay operates as granting Trump de facto immunity.\u201d<\/p>\n\n\n\n<p>The Supreme Court&nbsp;<a href=\"https:\/\/www.dailywire.com\/news\/supreme-court-deals-blow-to-jack-smith-refuses-to-quickly-take-up-trump-immunity-claim\" target=\"_blank\" rel=\"noreferrer noopener\">denied<\/a>&nbsp;a bid by Smith in December to fast-track consideration of the immunity claim while Trump\u2019s lawyers&nbsp;<a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/23\/23-624\/293865\/20231220140543301_23-624%20-%20U.S.%20v.%20Trump%20-%20Brief%20in%20Opposition%20to%20Petition%20for%20Certiorari%20Before%20Judgment%20-%20Filed.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">argued<\/a>&nbsp;the question should be considered in a \u201ccautious, deliberative manner.\u201d<\/p>\n\n\n\n<p>Trump has pleaded not guilty in the federal case in which he is accused of unlawfully plotting to overturn the results of the 2020 election. His lawyers&nbsp;<a href=\"https:\/\/www.politico.com\/news\/2023\/10\/05\/trump-election-case-immunity-motion-00120225\" target=\"_blank\" rel=\"noreferrer noopener\">filed to dismiss<\/a>&nbsp;the case in October by arguing that Trump\u2019s actions were \u201cwithin the heartland\u201d of his \u201cofficial duties.\u201d<\/p>\n\n\n\n<p>U.S. District Judge Tanya Chutkan, an appointee of former President Barack Obama, rejected Trump\u2019s immunity claim,\u00a0<a href=\"https:\/\/www.pbs.org\/newshour\/politics\/trump-appeals-ruling-rejecting-immunity-claim-as-window-narrows-to-delay-federal-election-case\" target=\"_blank\" rel=\"noreferrer noopener\">saying<\/a>\u00a0that the defendant\u2019s \u201cfour-year service as Commander in Chief did not bestow on him the divine right of kings to evade the criminal accountability that governs his fellow citizens.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p>Trump is facing three other criminal cases, including another one led by Smith over the former president\u2019s handling of classified documents.<\/p>\n\n\n\n<p>Trump recently cited presidential immunity in a request to\u00a0<a href=\"https:\/\/www.axios.com\/2024\/02\/23\/trump-classified-documents-presidential-immunity\" target=\"_blank\" rel=\"noreferrer noopener\">get the documents case dismissed<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>On Wednesday, the U.S. Supreme Court announced it will take up the issue of whether former President\u00a0Donald Trump\u00a0can invoke presidential immunity to shield himself from federal prosecution.
