On Tuesday, Donald Trump\u2019s attorneys moved for a mistrial in his first criminal case, citing the salacious testimony of ex-porn star\u00a0Stormy Daniels.<\/p>\n\n\n\n

\u201cThe guardrails for this witness, answering questions from the government, were just thrown to the side,\u201d Trump attorney Todd Blanche said.<\/p>\n\n\n\n

Prosecutors called Daniels, a porn star, to the stand on Tuesday.<\/p>\n\n\n\n

\u201cI do think some things were better unsaid,\u201d Judge\u00a0Juan Merchan\u00a0<\/a>said. \u201cI don\u2019t believe we are at the point where a mistrial is warranted.\u201d\u00a0<\/p>\n\n\n\n

Blanche asked for a mistrial after the court reconvened following the lunch break. Daniels had taken the stand in the morning, testifying in sordid detail about the alleged sexual encounter.<\/p>\n\n\n\n

Blanche suggested that Daniels\u2019 story has changed since 2016 from a consensual affair to be more dubious and that some of the details the jury was allowed to hear, including that he didn\u2019t use a condom, were inappropriate.<\/p>\n\n\n\n

\u201cHow can you just let them ring the bell?\u201d Blanche said.<\/p>\n<\/blockquote>\n\n\n\n

Susan Hoffinger, a prosecutor with the Manhattan district attorney\u2019s office, pushed back against Blanche\u2019s accusations.<\/p>\n\n\n\n

\u201cIn your motions, your honor did not put any guardrails on the testimony,\u201d she said, claiming that Daniels\u2019s story has been public for several years and the defense should not be surprised by her testimony.<\/p>\n<\/blockquote>\n\n\n\n
