{"id":6821,"date":"2024-05-22T10:41:37","date_gmt":"2024-05-22T14:41:37","guid":{"rendered":"https:\/\/greatamericanewsdesk.com\/?p=6821"},"modified":"2024-05-22T10:41:39","modified_gmt":"2024-05-22T14:41:39","slug":"trump-motions-to-dismiss-classified-docs-case","status":"publish","type":"post","link":"https:\/\/greatamericanewsdesk.com\/news\/trump-motions-to-dismiss-classified-docs-case\/njackson\/2024\/05\/","title":{"rendered":"Trump Motions To Dismiss Classified Docs Case"},"content":{"rendered":"\n<p>On Tuesday, former President Donald Trump&#8217;s legal team filed a motion to dismiss the classified documents case.<\/p>\n\n\n\n<p>Trump&#8217;s lawyers asserted that prosecutors in the classified documents case violated his constitutional rights on several occasions, including the &#8220;unconstitutional&#8221; raid on Mar-a-Lago.<\/p>\n\n\n\n<p>In their&nbsp;<a href=\"https:\/\/cdn01.dailycaller.com\/wp-content\/uploads\/2024\/05\/show_multidocs-1.pdf\">filing<\/a>&nbsp;on the raid, Trump\u2019s attorneys argued the warrant, which they said was \u201cexecuted in an egregious fashion and in bad faith,\u201d lacked \u201cthe particularity required by the Fourth Amendment.\u201d<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>The warrant did not establish a basis for \u201crummaging through the majority\u201d of the rooms at Mar-a-Lago, including \u201cthe private bedrooms of the First Lady and President Trump\u2019s youngest son,\u201d Trump\u2019s attorneys wrote. They asked that evidence gathered from the raid, along with through a \u201csubsequent unlawful violation of President Trump\u2019s attorney-client privilege,\u201d be suppressed.<\/p>\n\n\n\n<p>\u201cWhat was unthinkable with respect to President Clinton\u2019s recordings, and deemed unwarranted with respect to Hillary Clinton\u2019s destruction of evidence, was determined to be appropriate by the Biden Administration for President Biden\u2019s chief political rival,\u201d his attorneys wrote. \u201cPersonally authorized by Attorney General Garland, and supported over FBI objections by DOJ leadership who did not \u2018give a damn about the optics\u2019 of these unprecedented steps, the raid of Mar-a-Lago was unconstitutional.\u201d<\/p>\n<\/blockquote>\n\n\n\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\"><div class=\"wp-block-embed__wrapper\">\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\"><p lang=\"en\" dir=\"ltr\">NEW: Trump&#39;s latest motion to dismiss classified docs case just hit the docket.<br><br>Trump accuses Jack Smith of prosecutorial abuse and denial of due process.<br><br>Trump again accuses Biden White House of colluding with National Archives to concoct the case: <a href=\"https:\/\/t.co\/AfUmu50hzE\">pic.twitter.com\/AfUmu50hzE<\/a><\/p>&mdash; Julie Kelly \ud83c\uddfa\ud83c\uddf8 (@julie_kelly2) <a href=\"https:\/\/twitter.com\/julie_kelly2\/status\/1792947730660069829?ref_src=twsrc%5Etfw\">May 21, 2024<\/a><\/blockquote><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script>\n<\/div><\/figure>\n\n\n\n<p>In the other motion to&nbsp;<a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.flsd.648653\/gov.uscourts.flsd.648653.561.0_1.pdf\">dismiss<\/a>, Trump\u2019s attorneys argued that \u201cNARA, the Biden Administration, and DOJ \u2018collude[d] in bad faith\u2019 to deprive President Trump of his constitutional rights by using civil authorities to collect evidence for use in a criminal prosecution.\u201d<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cPolitically biased NARA officials violated the agency\u2019s regulations, and broke custom and practice dating back to the enactment of the [Presidential Records Act], by colluding with the Biden Administration to initiate a criminal investigation of President Trump rather than simply collecting the records that President Trump had designated as Presidential Record,\u201d they wrote.<\/p>\n\n\n\n<p>\u201cAs a result of this misconduct, under the guise of NARA\u2019s civil and administrative authorities, the prosecution team collected evidence\u2014including the 15 Boxes and statements by President Trump\u2019s PRA representatives\u2014that they used to further the criminal investigation in an unfairly prejudicial and unlawful fashion,\u201d Trump\u2019s attorneys continued.<\/p>\n<\/blockquote>\n\n\n\n<p>The government\u00a0<a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.flsd.648653\/gov.uscourts.flsd.648653.567.0.pdf\">wrote<\/a>\u00a0in response to Trump\u2019s Mar-a-Lago filing that it \u201cadopted a measured, graduated approach\u201d since the start of the case.
