On Wednesday, Special Counsel Jack Smith formally appealed a federal judge\u2019s dismissal of criminal charges against former President Trump over his alleged mishandling of classified information<\/a>.<\/p>\n\n\n\n

Smith\u2019s office filed a notice saying it would appeal Florida-based U.S. District Judge Aileen Cannon\u2019s ruling tossing out the 40 charges Trump faced to the 11th Circuit Court of Appeals.<\/p>\n\n\n\n

The Trump-appointed judge on Monday ruled that Attorney General Merrick Garland <\/a>did not have the authority to appoint a federal officer with the \u201ckind of prosecutorial power wielded by Special Counsel Smith.\u201d<\/p>\n\n\n\n

\u201cThe bottom line is this: The Appointments Clause is a critical constitutional restriction stemming from the separation of powers, and it gives to Congress a considered role in determining the propriety of vesting appointment power for inferior officers,\u201d Cannon wrote in a 93-page ruling.  <\/p>\n\n\n\n

\u201cThe Special Counsel\u2019s position effectively usurps that important legislative authority, transferring it to a Head of Department, and in the process threatening the structural liberty inherent in the separation of powers.\u201d <\/p>\n\n\n\n

The ruling marked a major victory for Trump \u2014 the first time one of his four criminal cases has been dismissed entirely \u2014 and came on the heels of an attempted assassination of the former president. Trump said the dismissal should be seen as the \u201cfirst step\u201d toward \u201cUniting our Nation\u201d following the failed effort to take his life, calling for his other cases to be dismissed.<\/p>\n\n\n\n

A spokesperson for the special counsel\u2019s office said Monday that Cannon\u2019s ruling \u201cdeviates from the uniform conclusion of all previous courts to have considered the issue that the Attorney General is statutorily authorized to appoint a Special Counsel.\u201d<\/p>\n\n\n\n
