In ruling otherwise, the district court deviated from binding Supreme Court precedent, misconstrued the statutes that authorized the Special Counsel\u2019s appointment, and took inadequate account of the longstanding history of Attorney General appointments of special counsels,\u201d Smith\u2019s team wrote.<\/p>\n<\/blockquote>\n\n\n\n<p>Monday\u2019s brief, filed a day&nbsp;<a href=\"https:\/\/thehill.com\/regulation\/court-battles\/4778028-jack-smith-appeal-trump-classified-documents-case\/\" target=\"_blank\" rel=\"noreferrer noopener\">ahead of the deadline<\/a>, offers a lengthy review of the special counsel statutes. It also takes particular issue with Cannon\u2019s conclusion that the Supreme Court\u2019s review of special counsel authority was \u201cdicta,\u201d or a remark essentially made in passing while discussing other issues in the case.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cApart from the district court below, every court to consider the question has concluded that the Supreme Court\u2019s determination that those statutes authorized the Attorney General to appoint the Watergate Special Prosecutor was necessary to the decision that a justiciable controversy existed and therefore constitutes a holding that binds lower courts,\u201d prosecutors wrote.<\/p>\n\n\n\n<p>The filing also points to bigger picture issues, writing that Cannon \u201cerroneously disregarded [special counsel appointment] history as \u2018spotty\u2019 or \u2018ad hoc,\u2019\u201d warning of the risks if her ruling is upheld.<\/p>\n<\/blockquote>\n","protected":false},"excerpt":{"rendered":"<p>Special Counsel Jack Smith urged a federal appeals court to\u00a0reinstate the classified documents case\u00a0against former President\u00a0Donald Trump on Monday.
