{"id":8563,"date":"2025-01-06T10:36:30","date_gmt":"2025-01-06T15:36:30","guid":{"rendered":"https:\/\/greatamericanewsdesk.com\/?p=8563"},"modified":"2025-01-06T10:36:31","modified_gmt":"2025-01-06T15:36:31","slug":"trump-files-motion-to-halt-hush-money-case-sentencing","status":"publish","type":"post","link":"https:\/\/greatamericanewsdesk.com\/crime\/trump-files-motion-to-halt-hush-money-case-sentencing\/njackson\/2025\/01\/","title":{"rendered":"Trump Files Motion To Halt Hush Money Case Sentencing"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\">Time is running out&#8230;<\/h2>\n\n\n\n<p>On Monday, President-elect Donald Trump&#8217;s legal team filed a motion urging Judge Juan Merchan to hold off on sentencing him on Jan. 10 in his New York criminal conviction.<\/p>\n\n\n\n<p>Last week, the New York judge announced sentencing would\u00a0move forward this Friday\u00a0despite his imminent return to the White House<\/p>\n\n\n\n<p><a href=\"https:\/\/www.documentcloud.org\/documents\/25479187-trump-sentencing-stay-notice\/\">Trump\u2019s attorneys told Merchan<\/a>&nbsp;they are appealing his recent rulings upholding the jury\u2019s guilty verdict and argued the judge must pause the case in the meantime.&nbsp;<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cBy virtue of President Trump\u2019s filing of appellate proceedings raising his claims of Presidential immunity, all proceedings in this Court are automatically stayed by operation of federal constitutional law,\u201d Trump\u2019s attorneys wrote in the new filing, which was made public Monday.&nbsp;<\/p>\n\n\n\n<p>\u201cIn the alternative, even if such a stay were discretionary, the Court should grant such a stay. The Court should vacate the sentencing hearing scheduled for January 10, 2025, and suspend all further deadlines in the case until President Trump\u2019s immunity appeals are fully and finally resolved, which should result in a dismissal of this case, which should have never been brought in the first place,\u201d they continued.&nbsp;<\/p>\n<\/blockquote>\n\n\n\n<p>They asked Merchan to notify the parties by 2 p.m. EST Monday whether he will cancel the sentencing and said they would be filing two appeals Monday in state court.&nbsp;<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cThe Supreme Court\u2019s historic decision on Immunity, the state constitution of New York, and other established legal precedent mandate that this meritless hoax be immediately dismissed,\u201d Trump spokesperson Steven Cheung, who is set to become White House communications director, said in a statement.\u00a0<\/p>\n<\/blockquote>\n\n\n\n<p>A New York jury found Trump guilty on 34 counts of falsifying business records in connection with a hush money payment made to adult film performer Stormy Daniels ahead of the 2016 presidential election so she would keep an alleged affair secret. &nbsp;<\/p>\n\n\n\n<p>It is the only one of Trump\u2019s criminal prosecutions to have reached trial.<\/p>\n\n\n\n<p>Trump\u2019s sentencing in New York comes after the judge rejected two of his attempts to dismiss the case.<\/p>\n\n\n\n<p>In scheduling Friday\u2019s sentencing, Merchan rejected a proposal to delay the proceeding until after Trump\u2019s White House term, calling it \u201cless desirable\u201d and citing a need for finality in the case.<br><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Time is running out&#8230; On Monday, President-elect Donald Trump&#8217;s legal team filed a motion urging Judge Juan Merchan to hold off on sentencing him on Jan. 10 in his New York criminal conviction.
