{"id":8615,"date":"2025-01-09T14:41:47","date_gmt":"2025-01-09T19:41:47","guid":{"rendered":"https:\/\/greatamericanewsdesk.com\/?p=8615"},"modified":"2025-01-09T14:41:48","modified_gmt":"2025-01-09T19:41:48","slug":"fani-willis-requests-top-georgia-court-reconsider-disqualification-from-trump-case","status":"publish","type":"post","link":"https:\/\/greatamericanewsdesk.com\/featured\/fani-willis-requests-top-georgia-court-reconsider-disqualification-from-trump-case\/njackson\/2025\/01\/","title":{"rendered":"Fani Willis Requests Top Georgia Court Reconsider Disqualification From Trump Case"},"content":{"rendered":"\n<p>Fulton County District Attorney\u00a0Fani Willis\u00a0(D) asked Georgia\u2019s top court to review her disqualification from the election subversion case against President-elect Trump and several allies.<\/p>\n\n\n\n<p>In a&nbsp;<a href=\"https:\/\/www.documentcloud.org\/documents\/25482946-willispetititiongasupremecourt\/#document\/p1\">petition filed late Wednesday<\/a>&nbsp;to the Supreme Court of Georgia, Willis said the state\u2019s midlevel appeals court \u201coverreached\u201d its authority in \u201call directions\u201d when it decided she should be removed from the prosecution over her past romantic relationship with a top prosecutor on the case.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cNo Georgia court has ever disqualified a district attorney for the mere appearance of impropriety without the existence of an actual conflict of interest,\u201d Willis\u2019s office wrote. \u201cAnd no Georgia court has ever reversed a trial court\u2019s order declining to disqualify a prosecutor based solely on an appearance of impropriety.\u201d&nbsp;<\/p>\n<\/blockquote>\n\n\n\n<p>Georgia\u2019s Court of Appeals disqualified Willis and her office from the 2020 election case last month in a 2-1 decision over her inappropriate romance with former special prosecutor\u00a0Nathan Wade.<\/p>\n\n\n\n<p>The state\u2019s high court, controlled by justices appointed by Republican governors, must first decide whether to take up the appeal at all.<\/p>\n\n\n\n<p>Even if the court hears Willis\u2019s appeal and rules in her favor, she\u00a0may not have a chance to resurrect the case until 2029 \u2014 after Trump has left office \u2014 since legal experts agree sitting presidents cannot be criminally prosecuted.<\/p>\n\n\n\n<p>If it lets the appeals court\u2019s ruling stand, the case would be handed off to the Prosecuting Attorneys\u2019 Council of Georgia, a nonpartisan state agency.
