On Wednesday, the Supreme Court in a\u00a05-4 emergency ruling<\/a> refused to halt a judge\u2019s decision ordering the Trump administration to immediately release nearly $2 billion in foreign aid payments owed under existing contracts.\u00a0<\/p>\n\n\n\n

It hands a loss to the administration in the first time that Trump\u2019s efforts to drastically reshape federal spending, agency by agency, have reached the high court. <\/p>\n\n\n\n

Chief Justice\u00a0John Roberts\u00a0and Justice\u00a0Amy Coney Barrett\u00a0joined with the court\u2019s three liberals to side against the administration.\u00a0<\/p>\n\n\n\n

Four of the court\u2019s conservatives \u2014 Justices Clarence Thomas, Samuel Alito, Neil Gorsuch and Brett Kavanaugh \u2014 dissented. <\/p>\n\n\n\n

\n

\u201cDoes a single district-court judge who likely lacks jurisdiction have the unchecked power to compel the Government of the United States to pay out (and probably lose forever) 2 billion taxpayer dollars? The answer to that question should be an emphatic \u2018No,\u2019 but a majority of this Court apparently thinks otherwise. I am stunned,\u201d Alito wrote, joined by the three others. <\/p>\n<\/blockquote>\n\n\n\n

The Trump administration\u00a0has broadly sought to dismantle\u00a0the U.S. Agency for International Development (USAID), including by firing employees and\u00a0freezing its payments\u00a0to contractors, sparking a wave of lawsuits.\u00a0<\/p>\n\n\n\n

The Supreme Court\u2019s emergency decision keeps in place a lower judge\u2019s order enforcing his directive that the administration maintain foreign aid agreements that existed before Trump took office.\u00a0<\/p>\n\n\n\n
