McIver was joined by several Democratic colleagues and Newark Mayor Ras Baraka.<\/p>\n\n\n\n<p><a href=\"https:\/\/www.justice.gov\/usao-nj\/pr\/congresswoman-charged-forcibly-impeding-and-interfering-federal-officers\" target=\"_blank\" rel=\"noreferrer noopener\">According<\/a> to the U.S. Attorney\u2019s Office for the District of New Jersey, McIver allegedly struck two federal officers \u2014 once with her forearm and again while attempting to block the arrest of Mayor Baraka. Baraka had entered a restricted area without authorization. LaMonica McIver has been indicted and faces up to 17 years in prison for allegedly assaulting federal law enforcement officers.<br><br>US Attorney Alina Habba made the announcement on X.<br><br>\u201cToday a federal grand jury seated in Newark, New Jersey returned a three-count\u2026 <a href=\"https:\/\/t.co\/0o6axUEy7t\">pic.twitter.com\/0o6axUEy7t<\/a><\/p>&mdash; Collin Rugg (@CollinRugg) <a href=\"https:\/\/twitter.com\/CollinRugg\/status\/1932579873459147259?ref_src=twsrc%5Etfw\">June 10, 2025<\/a><\/blockquote><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/div>\n<\/div><\/figure>\n\n\n\n<p>As <em>The Washington Post<\/em> <a href=\"https:\/\/www.washingtonpost.com\/national-security\/2025\/06\/10\/lamonica-mciver-indicted-alina-habba-new-jersey\/?utm_source=chatgpt.com\" target=\"_blank\" rel=\"noreferrer noopener\">reports<\/a>:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><em>Video released by the Department of Homeland Security showed McIver rushing after the agents as they tried to arrest Baraka outside the facility\u2019s gates and shouting to protesters outside to \u201csurround the mayor.\u201d At one point, McIver\u2019s elbows appear to make contact with a masked officer amid the crush of the crowd.<\/em><\/p>\n\n\n\n<p><em>The two other members of Congress have not been charged.<\/em><\/p>\n\n\n\n<p><em>Habba and McIver havepublicly said that prosecutors tried to reach a resolution with McIver without pressing charges but were not successful, though neither provided details.<\/em><\/p>\n\n\n\n<p><em>\u201cThe Justice Department and Alina Habba wanted me to admit to doing something that I did not do, and I was not going to do that,\u201d McIver said on CNN last month. \u201cI came here to do my job and conduct an oversight visit, and they wanted me to say something differently, and I\u2019m not doing that.\u201d<\/em><\/p>\n<\/blockquote>\n\n\n\n<p>Federal prosecutors claim McIver\u2019s actions constituted assault and obstruction of federal officers in the performance of their duties.<\/p>\n\n\n\n<p>McIver has denied the allegations, claiming the charges are politically motivated and amount to intimidation over her work on immigration oversight. Her attorney, Paul J. Fishman, called the case \u201cpolitical retaliation against a dedicated public servant who refuses to shy away from her oversight responsibilities\u201d and vowed to prove her innocence in court.<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\"><div class=\"wp-block-embed__wrapper\">\n<div class=\"embed-twitter\"><blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\"><p lang=\"en\" dir=\"ltr\">This indictment is no more justified than the original charges. Criminal indictments of sitting members of Congress are rare \u2014 especially ones that don\u2019t involve financial misconduct or corruption. This case centers instead on conduct during an official visit tied to immigration enforcement.<\/p>\n\n\n\n<p>Legal experts say the indictment could reignite debate over how much leeway lawmakers have in conducting oversight of federal agencies, particularly those involving immigration detention practices.<\/p>\n\n\n\n<p>An arraignment date for McIver has not yet been set.
