{"id":9899,"date":"2025-06-27T10:25:43","date_gmt":"2025-06-27T14:25:43","guid":{"rendered":"https:\/\/greatamericanewsdesk.com\/?p=9899"},"modified":"2025-06-27T10:25:56","modified_gmt":"2025-06-27T14:25:56","slug":"supreme-court-allows-trump-to-partially-enforce-birthright-citizenship-order","status":"publish","type":"post","link":"https:\/\/greatamericanewsdesk.com\/featured\/supreme-court-allows-trump-to-partially-enforce-birthright-citizenship-order\/njackson\/2025\/06\/","title":{"rendered":"Supreme Court Allows Trump To Partially Enforce Birthright Citizenship Order"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\">Just in&#8230;<\/h2>\n\n\n\n<p>The Supreme Court granted a partial stay Friday of President\u00a0Donald Trump&#8217;s request to block lower courts from issuing universal injunctions, granting a par victory for the administration as it looks to execute many of its top priorities via executive order and action.\u00a0<\/p>\n\n\n\n<p>In a 6-3 ruling along ideological lines allowed President Trump\u2019s&nbsp;<a href=\"https:\/\/thehill.com\/homenews\/house\/5106060-trump-birthright-citizenship-republicans\/\" target=\"_blank\" rel=\"noreferrer noopener\">executive order restricting birthright citizenship<\/a>&nbsp;to go into effect in some areas of the country, for now, by curtailing judges\u2019 ability to block the president\u2019s policies nationwide.&nbsp;<\/p>\n\n\n\n<p>Ruling that three federal district judges went too far in issuing nationwide injunctions against Trump\u2019s order, the high court\u2019s decision claws back a key tool that plaintiffs have used to hamper the president\u2019s agenda in dozens of lawsuits.&nbsp;<\/p>\n\n\n\n<p>But it does not yet definitively resolve whether Trump\u2019s restrictions on birthright citizenship are constitutional, a hefty legal question that could ultimately return to the justices.&nbsp;<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>&#8220;The applications do not raise\u2014and thus we do not address\u2014the question whether the Executive Order violates the Citizenship Clause or Nationality Act,&#8221; Justice Amy Coney Barrett said, writing for the majority. &#8220;The issue before us is one of remedy: whether, under the Judiciary Act of 1789, federal courts have equitable authority to issue universal injunctions.&#8221;<\/p>\n\n\n\n<p>&#8220;A universal injunction can be justified only as an exercise of equitable authority, yet Congress has granted federal courts no such power,&#8221; she added.<\/p>\n<\/blockquote>\n\n\n\n<p><em>This is a breaking news story.
