Federal Judge Blocks Pardoned J6 Defendants From DC, Capitol Building

A federal district judge has issued an order barring certain January 6 defendants with commutations from entering Washington, D.C., or the U.S. Capitol building. 

The filing says the order is effective at noon on Friday. 

Fox News reports:

In the filing, Judge Amit P. Mehta specified the order applied to “Defendants Stewart Rhodes, Kelly Meggs, Kenneth Harrelson, Jessica Watkins, Roberto Minuta, Edward Vallejo, David Moerchel, and Joseph Hacket” – whose sentences were commuted. Those pardoned are not subject to the order.

The order states “You must not knowingly enter the District of Columbia without first obtaining the permission from the Court” and “You must not knowingly enter the United States Capitol Building or onto surrounding grounds known as Capitol Square.”

  1. Why would they want to enter the place where they were made to suffer for only demanding their constitutional rights.? This does demonstrate the fearful attitude and small mindedness of many on the left.

  2. Judge Mehta is a piece of Resistance trash. Like the Pathetic lecturing twit of a Bishop from the Church of no Sin, they all seem to want their 15 minutes. He will get the Memo soon enough.

  3. That is a modification of Trump’s Pardon, is it not? Is it even legal for him to do? If that can be done then why can’t any of the pardons and commutations that Joe Biden gave away be modified as well by the Courts or Executive Branch?

  5. The 14th Amendment to the United States Constitution was passed by Congress and then ratified two years later on July 9, 1868, immediately after the American Civil War. It addressed pertinent issues resulting from the war: equal protection, voting and apportionment, citizenship, slavery, and who may hold public office.
    At the time when the Fourteenth Amendment was ratified, the United States still had a wide-open frontier and did not limit immigration. As there was no immigration law, there were no illegal immigrants and citizenship for children of immigrants was not an issue. Since the United States had no formal immigration policy at that time, the authors of the 14th Amendment envisioned no need to explicitly address immigration in the Amendment.
    Senator Jacob Howard (co-author) clearly spelled out the intent of the 14th Amendment in 1866, which was to define citizenship. He stated:
    “Every person born within the limits of the United States, and subject to their jurisdiction, is by virtue of natural law and national law a citizen of the United States. This will not, of course, include persons born in the United States who are foreigners, aliens, who belong to the families of ambassadors or foreign ministers accredited to the Government of the United States, but will include every other class of persons. It settles the great question of citizenship and removes all doubt as to what persons are or are not citizens of the United States. This has long been a great desideratum in the jurisprudence and legislation of this country.”
    The correct interpretation of the 14th Amendment is quite simply that an illegal alien mother is subject to the jurisdiction of her native country, as is her baby.
    The Amendment’s key phrase “subject to the jurisdiction thereof” was intended to exclude American-born persons from automatic citizenship whose allegiance to the United States was not complete. When parents are unlawfully in the United States, their native country has a claim of allegiance of a child born to those parents. The completeness of their allegiance to the United States is therefore impaired, which precludes automatic citizenship.

  6. Why would any of these people wish to go to the Capitol after what the committee has done to them? They were illegally indicted without a jury to prove their innocence. They were only doing what they are allowed by the constitution as a right to protest. The judge is full of crap and should not be re-elected to serve on the bench.

  7. The order is illegal on its face. A pardon grants the same legal status as never having been charged. Therefore, ANY punishment based on the actions for which a pardon was issued violate due process.

    • Update: The headline is false. The illegal order applies to those whose sentence was commuted, not those that were pardoned.
      That said, NO judge has the legal authority to impose additional sentence after a commutation. That authority would GUT the power of commutation.

  8. And what are they going to do? Stop all cars entering DC and card the occupants to be sure none are on the “do not enter” list? How stupid.

  9. I was taught in school the Capital building belonged to us. The Capital police opened the doors and practically ordered the crowd to come in and the majority walked around as visitors do. The Capital building is still caged by fences etc. so I will never go to Washington or visit the Capital for fear of being arrested for looking at or touching anything. There are too many places in the U.S. that are really opened to the public and safer. Years ago, when my nephew went there on a school class trip there were no tall metal fences around the Capital only since the democrats have had control of the govt. I guess they want Washington and the Capital building only for themselves.

  10. Let it happen. It sets a new precedent re: Presidential Pardons. This opens the door for prosecuting the Biden Pardons. Perfect. Bring it!
