Texas Rep. Files Resolution To Remove Biden

Rep. Chip Roy (R-Texas) is crafting a resolution urging Vice President Harris to convene the Cabinet and declare President Biden unable to carry out the duties of the Oval Office after the poor debate performance Thursday.

“I intend to put forth a resolution calling upon the @VP to immediately use her powers under section 4 of the 25th Amendment to convene & mobilize the principal officers of the Cabinet to declare the @POTUS is unable to successfully discharge the duties and powers of his office,” Roy wrote on X.

Roy told reporters Friday morning that, ”I think anybody with eyes and anybody observing objectively last night saw an individual that is not capable of carrying out the duties the commander-in-chief in a world in which we’re, you know, facing increasing dangers.”

He added, “for those of us who follow this stuff internally, it has been very clear the declining status of the of the capacity of the president, but last night put it all out for all to see. Our colleagues on their side of the aisle can’t hide from it. And frankly, I don’t do this through a political lens, right. I mean, I don’t view it through the lens of well, is the timing good and bad for what happens in November or anything else? It’s just the simple fact of the matter is the president United States is not capable of doing the job.”

Section 4 of the 25th Amendment — which has never been used — says that if the vice president and a majority of the Cabinet or Congress deem the president as “unable to discharge the powers and duties of his office,” the vice president should “immediately assume the powers and duties of the office as Acting President.”

“Whenever the Vice President and a majority of either the principal officers of the executive departments or of such other body as Congress may by law provide, transmit to the President pro tempore of the Senate and the Speaker of the House of Representatives their written declaration that the President is unable to discharge the powers and duties of his office, the Vice President shall immediately assume the powers and duties of the office as Acting President,” the amendment reads.

Harris defended Biden’s debate performance on CNN immediately after Thursday night’s event, conceding he had a “slow start” but arguing he had a “strong finish” and had laid out a strong contrast between himself and Trump.

Rep. Roy’s move is among the harshest responses to Thursday’s debate which has prompted widespread concern among Democrats.

Several leading columnists for the New York Times are urging President Biden to drop out of the race, citing his poor performance during Thursday night’s debate.

“President Biden is a good man who capped a long career in public service with a successful presidential term. But I hope he reviews his debate performance Thursday evening and withdraws from the race, throwing the choice of a Democratic nominee to the convention in August,” Times columnist Nicholas Kristof wrote.

Thomas Friedman, another Times columnist, made a similar argument.

“I cannot remember a more heartbreaking moment in American presidential campaign politics in my lifetime,” he wrote, saying Biden “a good man and a good president, has no business running for re-election.”

Supreme Court Narrows Key Obstruction Law Used In Jan. 6 Prosecutions

    In a pivotal 6-3 decision on Friday, the Supreme Court made it more challenging to charge Jan. 6 defendants with obstruction, a ruling that could impact scores of cases.

    The ruling was notably not split along ideological lines, underscoring its significance.

    Justice Ketanji Brown Jackson, appointed by President Biden, joined the majority in Friday’s landmark decision, in sharp contrast to her strong words against Idaho‘s abortion ruling, which she bitterly criticized as a setback for “pregnant patients.” (RELATED: Supreme Court Allows Emergency Abortions To Resume In Idaho)

    In a surprising move, Justice Amy Coney Barrett broke away from her conservative peers and sided with the minority.

    Case Spotlight: Joseph Fischer

    The decision directly involves Joseph Fischer, a former police officer from Pennsylvania. Fischer, who participated in the U.S. Capitol riot, faces an obstruction charge among several other accusations, including assaulting a police officer and disorderly conduct.

    Fischer’s appeal specifically targeted the obstruction charge under Section 1512(c)(2). His defense argued that this statute, originally crafted to tackle evidence tampering following the Enron scandal, was being misapplied to his actions on Jan. 6.

    They asserted that the law’s intended scope was being overly stretched to cover protest activities​. On the other hand, the government argued that the statute’s broad language was deliberate, designed to address various obstruction forms, including those that disrupt official proceedings like the certification of electoral votes​​.

    Understanding Section 1512(c)(2)

    Section 1512(c)(2) penalizes those who “corruptly” obstruct, impede or interfere with official congressional investigations, carrying a maximum sentence of 20 years. The Justice Department utilized this statute to prosecute individuals whose actions postponed the Electoral College vote count on Jan. 6. However, Fischer and many others contended that the Biden administration‘s DOJ had repurposed the law from its original focus on document tampering to now include those involved in the Capitol riot.

    The Supreme Court’s decision could have profound implications on the Justice Department’s years-long prosecution of the Capitol attack.

    More than 350 rioters were charged with obstructing an official proceeding after mobbing the Capitol on the day Congress was set to certify now-President Biden’s win against Trump. Several members of the extremist Proud Boys and Oath Keepers groups were convicted of the charge, including the leaders of each group, Enrique Tarrio and Stewart Rhodes.

    Though most also faced other felony counts, 50 rioters were sentenced with the obstruction law as their only felony, according to Prelogar.

    Jackson signaled in a separate opinion that she believed it is possible for Fischer and the other defendants to still be prosecuted under the charge.

    “That issue remains available for the lower courts to determine on remand,” she wrote.

    Broader Implications

    The Supreme Court ruling may not only influence Fischer’s case but numerous other Jan. 6 defendants. It may even extend its impact to former President Trump, who faces related legal challenges.

    McConnell Breaks From Trump On ‘Vilifying’ Biden

    Senate Republican Leader Mitch McConnell (R-Ky.) notably diverged from former President Donald Trump’s harsh rhetoric toward President Joe Biden on Tuesday, calling the incumbent commander-in-chief a “good guy.”

    The Kentucky Republican’s remarks stand in contrast to Trump’s persistent portrayal of Biden as a corrupt figure intent on manipulating elections and targeting political adversaries.

    “I know Joe Biden pretty well. He’s a good guy; I like him personally,” McConnell shared with an audience in Louisville on Tuesday.

    Despite stylistic differences with Trump, McConnell maintains there are significant policy-driven arguments for opposing Biden. Other Republicans are encouraging Trump to focus on Biden’s job performance rather than personal attacks tonight.

    Moreover, McConnell remains critical of Biden’s policies. “I never thought he was moderate in the Senate, but he ran as a moderate,” he stated. “But as soon as the president got elected, he pretty much signed up with the far left of the Democratic Party, which has created another set of problems for all of you who are in business. This has been a regulatory nightmare by this administration.”

    A Tactical Endorsement

    On March 6, 2024, McConnell endorsed Trump for the upcoming presidential race. This endorsement followed Trump’s decisive victories on Super Tuesday, which solidified his position as the GOP front-runner. McConnell acknowledged the substantial support Trump had garnered from Republican voters, expressing his backing for Trump’s nomination in a strategic move to unite the party.

    The Path Forward?

    As the debate rapidly approaches, McConnell’s tempered tone towards Biden could offer Trump a blueprint for a more policy-focused campaign.     Democrats Turn On Biden After Embarrassing Debate

    Joe Biden’s disastrous debate performance has Democrats in full panic mode.

    Biden’s shocking debate showing has spurred more Democrats and political experts to publicly plea for the senior President to drop out of the race.

    Several leading columnists for the New York Times are urging President Biden to drop out of the race, citing his poor performance during Thursday night’s debate.

    “President Biden is a good man who capped a long career in public service with a successful presidential term. But I hope he reviews his debate performance Thursday evening and withdraws from the race, throwing the choice of a Democratic nominee to the convention in August,” Times columnist Nicholas Kristof wrote.

    Thomas Friedman, another Times columnist, made a similar argument.

    Despite the pleas for change the Biden campaign is committed to pushing forward.

    President Biden is “not dropping out” of the 2024 race, a campaign official said following a shaky debate performance late Thursday that spurred talk among some Democrats of whether he should be replaced atop the ticket.

    “Of course he’s not dropping out,” Biden campaign spokesperson Seth Schuster said in a text message.

    The president himself brushed off talk over whether he should bow out during a stop at a Waffle House following the debate.

    “No. It’s hard to debate a liar. The New York Times pointed out he lied 26 times,” he said, referring to former President Trump.

    Republican Governor Admits He Did Not Vote For Trump In Primary

    An unexpected response…

    Georgia Republican Governor Brian Kemp recently disclosed he did not vote for Donald Trump in the state’s primary.

    Kemp in an interview with CNN’s Kaitlin Collins on Wednesday, said he didn’t vote for anyone in the state’s primary because the GOP’s presidential race had already been decided.

    “I voted, but I didn’t vote for anybody. I mean, the race was already over when the primary got here,” Kemp told Collins. “Well, it would be, for me, personally, politically, I mean it would be interesting if I had’ve voted for him, it would be interesting if I didn’t, it would be interesting if I didn’t vote at all.”

    During his interview with Collins, Kemp said Trump should not focus on the 2020 or 2022 election during the debate. 

    “I think that hurts him with swing voters. I mean from what I’m hearing from people, they are not focused on what happened in 2020 or 2022,” he said. 

    Kemp and Trump have had a rocky relationship since Trump’s last year in office. In 2018, Kemp won the governor’s mansion partly because of a Trump endorsement. 

    In the aftermath of the 2020 presidential election, where Biden defeated Trump in Georgia by 12,000 votes, Kemp pointedly pushed back against Trump’s election fraud claims, leading Trump to call him a “clown” and a “fool.” 

    Kemp endorsed Trump in March in a short statement, saying, “I think he’d be better than Joe Biden. It’s as simple as that.”

    Arizona Election Worker Charged For Alleged Security Breach

    Authorities have arrested and charged an Arizona man for allegedly stealing a security fob and keys from a ballot tabulation center in Maricopa County.

    According to Fox News, Walter Ringfield, 37, who was a temporary election worker, was arrested for allegedly stealing items from a ballot tabulation center. 

    Security footage showed Ringfield allegedly taking a red lanyard with a crucial security fob and keys from a desk inside the facility. Despite initially denying the theft when confronted by his employer, a subsequent search of Ringfield’s vehicle uncovered the lanyard.

    Police later went to Ringfield’s home and arrested him. The lanyard and keys were found in his car. The missing fob was found inside his home.

    Ringfield was booked into jail and is accused of theft and criminal damage.

    Ringfield allegedly admitted to stealing the fob but said he “gave it back” after 20 minutes.

    “Walter stated his reason for taking the fob was because he wanted to ‘clean up,’” court documents read. “Walter said the job was temporary and he was trying to make it permanent, so he wanted to clean up.”‘

    Security fobs are used with special secure tablets. Because one was removed, the staff must now reprogram every fob and tablet. Maricopa County Election officials estimate the cost of the reprogramming to be more than $19,000.

    Arizona Secretary of State Adrian Fontes confirmed the incident

    “Our systems are not only designed to detect anomalies but are also supported by dedicated professionals committed to upholding the democratic process,” Fontes said in a statement, according to Fox News. “While this event is unwelcome, it speaks to the effectiveness of the security protocols built into Arizona’s election systems.”

    At a press conference on Tuesday, Maricopa County Sheriff Russ Skinner said election staffers and law enforcement’s “swift response and ultimate action helped safeguard democracy and rapid response to the security protocols we have with elections proved to be effective.” 

    “If it wasn’t for the staff members at the Maricopa County Elections Center, we wouldn’t have been able to get on this in time to potentially find the missing evidence and get a suspect in custody,” he said.

    Polling Expert Gives Candidate 66% Chance Of Winning Election

    Bad news for Biden…

    Polling expert Nate Silver is predicting Donald Trump finds himself back in the White House.

    Silver was acclaimed in 2012 for correctly picking the winner of every state between Barack Obama and Mitt Romney and confidently forecasting an Obama victory. He was bullish on Hillary Clinton in 2016 but cautioned Trump had a reasonable chance.

    “The candidate who I honest-to-God think has a better chance (Trump) isn’t the candidate I’d rather have win (Biden),” Silver, who formerly ran polling analysis website FiveThirtyEight, wrote in his “Silver Bulletin” substack. 

    Silver’s forecast model, based on 40,000 simulations, found Trump had a 65.7% of winning the electoral college, compared to Biden, who had a 33.7% chance. However, Biden is slightly favored to win the popular vote. Trump lost the popular vote in 2016 but won the presidency with a slew of narrow swing state wins.

    “If the Electoral College/popular vote gap looks anything like it did in 1 or 2020, you’d expect Biden to be in deep trouble if the popular vote is roughly tied,” Silver wrote.

    The data expert wrote that there was still time for Biden to turn things around and suggested the president give the nomination to Vice President Harris or someone else at the Democratic convention. However, he wrote, “Disclaimer: that also might be a terrible idea.”`

    Donald Trump Jr. Shreds Potential VP Pick

    Donald Trump Jr. is sharing his two cents about his father’s ongoing search for a vice president…

    Don Jr. tore into former South Carolina Governor Nikki Haley who is also rumored to be one of Trump’s contenders for vice president.

    “Nikki Haley, who served as the puppet of Democrat billionaires and warmongerers, would be a wonderful choice is [sic] my dad wants to get impeached within about 7 seconds of being sworn in,” wrote Trump Jr. “She’s they’re [sic] last hope!”

    According to Mediaite, the eldest son of the former president has been “pushing” for Senator J.D. Vance (R-OH) behind the scenes. In January, Trump Jr. told Newsmax that he’d “love to see a J.D. Vance” on the ticket with his dad  because he’s “principally in alignment” with his dad as well as “a fighter.”

    Haley, the last challenger to drop out of the GOP presidential primary earlier this year, declined to endorse Donald Trump immediately after leaving the race. However, Haley eventually came to her senses and endorsed the former president.

    The former president already dismissed speculation last month that he would choose the former United Nations ambassador as his vice president.

    “Nikki Haley is not under consideration for the V.P. slot, but I wish her well!” former Presidnt Trump wrote in a Truth Social post in May.

    MAGA Congresswoman Topples GOP Challenger, ‘Squad’ Democrat Defeated

    A sign of a Republican wave?

    Popular MAGA firebrand Lauren Boebert (R-Colo.) cruised into her congressional re-election primary campaign to victory Tuesday night.

    Boebert’s win comes after switching districts to a more Republican-heavy area after a narrow win in 2022.

    Boebert advanced past a six-way Republican primary in Colorado’s 4th Congressional District in a race to replace outgoing Republican Rep. Ken Buck.

    The Colorado Republican said she made the switch to CO-04 to ensure another Republican could win her old district, which she nearly lost in 2022 and had blamed outside groups for targeting her. But Boebert left the district having already become a fundraising magnet for the likely Democrat candidate, who has pulled in millions that may help him flip a district that has leaned Republican in recent years.

    Boebert is expected to also win the November general election in the district. Its voters overwhelmingly backed former President Trump in 2020.

    Republicans on the opposite side of the country are also celebrating a significant Tuesday win when progressive Democrat Jamaal Bowman (N.Y.) suffered a double-digit loss. New York’s Republican Party celebrated the first ouster of a “Squad” member since the progressive coalition’s inception in 2018 to Westchester County Executive George Latimer, a pro-Israel moderate Democrat. 

    “Good riddance, Jamaal. Every socialist in Congress and the State Legislature should likewise be rooted out of public office,” New York GOP Chair Ed Cox said in a statement Wednesday. “Jamaal Bowman just faced the consequences of his disgraceful actions. From his childish fire alarm stunt to his blatant anti-Semitic remarks and his latest public meltdown, Bowman has repeatedly shown he is unfit for office.” 

    Latimer welcomed his victory with a message of unity. 

    “Tonight we turn a page, and we say that we believe in inclusion of everybody in our representation. That you are included, no matter what your demographic is. Doesn’t matter your age, the color of your skin, your religion, sexual identity, whether you’re a right hander or left hander, whether you’re a Met fan or a Yankee fan,” Latimer joked. 

    “We go to Washington, we’re one of 435. But we’re not the only one. You know, good men and women in Washington who feel the same way we do, and we have to find each other and link with each other. We have to look at arguments of the far right and the far left and say you cannot destroy this country with your rhetoric and your arguments,” he said, garnering cheers from the crowd. “We have to have unity all across that continuum, and if you hold a strong belief, you still must work with other people don’t share that belief because America hangs in the balance.” 

    ‘Sopranos’ Star Admits There Are Lots Of ‘Quiet’ Trump Voters

    Sopranos actress Drea de Matteo told Fox News host Jesse Watters there are “a lot” of “quiet” Donald Trump supporters in Hollywood despite liberal media’s portrayal otherwise.

    The actress, who played Adriana La Cerva on the critically acclaimed Sopranos, joined Watters on Monday and reacted to President Joe Biden’s recent Hollywood fundraiser where he raised $30 million and celebrities like Jack Black and Jimmy Kimmel took to the stage. Watters aired footage from the event, as well as a clip of Robert De Niro ranting against Donald Trump outside his hush money trial in Manhattan.

    “Is there a quiet Trump voter out there in Hollywood?” Watters asked.

    “Hello there, first of all. And I think there is a lot of them. I think there are a lot of — that was a hard intro to watch. I’m sorry,” de Matteo said.

    “Was it Jack Black’s legs?” Watters asked.

    “No, it’s the Italian, man. We’re talking about [Anthony] Fauci, we’re talking about De Niro. I am mortified right now by my people,” de Matteo said. “I don’t understand what we’re doing here.”

    “There are a lot of quiet Trump supporters, there are a lot of Kennedy supporters. And wow, I wonder how much the actors got paid to endorse Biden at this point. I’m curious, because that seems — I wonder if De Niro got paid a locations fee because he had to travel to the courtroom to do that,” she said.

    The actress appeared to be joking as she said doesn’t know the specifics of celebrities working with campaigns, calling herself and other Sopranos actors “outcasts.”

    “I don’t really maneuver inside that industry. I never have. First of all, Sopranos, we were the outcasts, even though we were critically acclaimed, we still were outcasts. So I’m still an outcast, here I am. They’re going to take me out into the woods and shoot me for not endorsing Biden,” she said.
