Potential McCarthy Replacement To Appear On Two Ballots

A California appellate court ruled Republican candidate Vince Fong can legally appear on both the state and federal congressional ballots this fall.

Fong, a mentee and ex-staff member for former Speaker Kevin McCarthy (R-Calif.), is running for his boss’ vacant seat.

Prior to McCarthy’s resignation, Fong also filed to run for reelection in the California State Assembly, where he represents the Bakersfield area.

California Secretary of State Shirly Weber (D) attempted to keep Fong out of the Congressional race, since he’d already declared for the state-level position and California law bars candidates from appearing twice. But, a judge ruled in late December that Fong could run.

The Hill has more:

Superior Court Judge Shelleyanne Chang ruled that Weber’s determination was “inapplicable” to Fong and said he could run in the 20th Congressional District. Chang noted that the law only applied to independent candidates for Congress, not partisan primaries.

The 3rd Court of Appeals agreed Tuesday, ruling that since Fong was not “seeking to utilize the independent nomination process,” the statute did not apply to him.

“If the Legislature wants to prohibit candidates from running for more than one office at the same election, it is free to do so,” the judges wrote. “Unless and until it does so, however, we must take section 8003 as we find it and enforce it as written.”

If Fong wins both elections, he would resign from the Assembly and head to Congress. A special election would be held to fill the Assembly vacancy in 2025, Fong spokesperson Ryan Gardiner told the Los Angeles Times.

Trump Endorses Ex-McCarthy Aide To Fill Open Seat

Former President Donald Trump has chosen to throw his support behind ex-House Speaker Kevin McCarthy’s chosen successor for his empty seat in Congress, Vince Fong.

Fong, a California Assembly member who worked as McCarthy’s district director for almost a decade, is one of nine candidates running to replace him in Central Valley for his House seat.

Fox News has more:

“I am proud to join California’s Republican Congressional Delegation, and give Vince Fong my Complete and Total Endorsement!” Trump wrote in a post on Truth Social. “Vince was one of only 6 Republicans in the State Assembly to stand with me, and reject the Second Impeachment Hoax. In Congress, Vince will work with me to Grow the Economy, Lower your Taxes, Cut Burdensome Regulations, Champion American Energy, and Protect and Defend the Second Amendment, which is under siege by the Radical Left.”

Endorsing Boudreaux last month, Grenell and Patel described him as the anti-establishment, America First choice. “Sheriff Mike Boudreaux is an America First patriot who has proven he is a principled fighter for freedom,” Grenell said, The Porterville Recorder reported at the time. “California needs leaders with courage to stand up to Washington bureaucrats. His record proves he is the right choice for the Valley.”

Patel said, “Sheriff Boudreaux is the kind of leader we need in Congress, one with the courage to stand up and fight, not back down, and put American first,” The Recorder reported.

Trump’s endorsement of Fong is likely to give him a boost with voters who may have been wary over his years-long ties to the GOP establishment. Fong wrote on X, the platform formerly known as Twitter, soon after the former president’s announcement, “Thank you… for your endorsement! Let’s get to work to secure the border, improve our economy, and defend our water and energy resources!”

Florida Republican Moves to Expel Adam Schiff from Congress

A Florida freshman representative is taking drastic measures since the release of the Durham report.

Rep. Anna Paulina Luna (R-Fl.) has filed a motion to have Rep. Adam Schiff (D-Calif.) expelled from Congress.

“He used his position on House Intelligence to push a lie that cost American taxpayers millions of dollars and abused the trust placed in him as Chairman,” Luna said in a statement Wednesday. “The Durham Report makes clear that the Russian Collusion was a lie from day one and Schiff knowingly used his position in an attempt to divide our country.”

Schiff, who was the top lawmaker on the House Intelligence Committee when Democrats the House majority, has repeatedly claimed that Trump and his campaign colluded with the Russian government to influence the 2016 election. 

While the Durham report did not recommend any new charges it did offer a blistering review of how the FBI launched and carried out the investigation. It caps a four-year investigation by Durham.

“I’m convinced when this dark chapter of our history is written, it will reflect that those Republican members who lacked the courage to stand up to the most unethical president in U.S. history, Donald Trump, consoled themselves by attacking those who did,” Schiff said in an interview with MSNBC on Wednesday.

The California Democrat also knocked the conclusions of the Durham report, fighting back against the idea that it proved that his claims of collusion between the Trump campaign and Russia were a lie.

“Durham spends four years trying to prove this deep state conspiracy theory that Trump kept telling his base was going to be proven,” Schiff said. “The whole thing, of course, was a big bust.”

Mike Pence Team Refutes Presidential Campaign Rumors

Former Vice President Mike Pence did not file campaign paperwork for a 2024 White House run.

On Monday, Pence spokesperson Devin O’Malley quickly tried to dispel reports after a Statement of Candidacy form was submitted to the Federal Election Commission in Pence’s name.

“Former Vice President Mike Pence did not file to run for President today,” O’Malley said in response to a reporter who tweeted Pence had entered the race.

“Someone filed a Pence filing. But it wasn’t Pence, his spokesman says, suggesting it was a prank,” tweeted New York Times reporter Maggie Haberman.

Despite the Pence team’s attempts to contain the fake news story, it wasn’t long before multiple outlets mistakenly reported the FEC submission.

While Pence is not responsible for the latest 2024 rumor the former Vice President has hinted at a presidential run in the near future. Last month, Pence told reporters he’s giving “prayerful consideration” to a 2024 bid.

If Pence ultimately does announce a 2024 White House run he would be facing off against his old boss on the debate stage, teeing up an intense primary battle.

Trump Snubs DeSantis in Latest Campaign Stop Announcement

Donald Trump is giving Florida Governor Ron DeSantis the silent treatment.

In what appears to be the latest rift between the two Republicans, Trump announced he plans to campaign for Florida Sen. Marco Rubio two days before Election Day, notably leaving out the Governor from the event.

Trump’s plan to hold a Nov. 6 rally in Miami shocked sources close to DeSantis who say the governor wasn’t notified of the event prior to the former president’s Wednesday announcement, according to Politico.

The timing of the Trump and Rubio event means any campaign event DeSantis holds that day won’t receive as much attention during the all-important final stretch of the 2022 midterms.

“You’ve got the Sunday before Election Day totally hijacked by Trump parachuting in on Trump Force One taking up the whole day,” said a longtime Republican consultant who is close to the governor. “No Republican could go to a DeSantis event that day. None. And DeSantis won’t be here? This is big.”

Another person who is influential in DeSantis’ world said it was “an elbow to Ron’s throat” and blamed Trump advisers.

However, an adviser close to Trump said that the event isn’t meant to take attention away from the Florida governor and is just part of a series of campaign stops scheduled for the former president.

“This is an event President Trump is holding as part of a series of stops he is making for Republican Senate candidates,” the Trump adviser said. “It came after he and Senator Rubio spoke directly.”

Trump and DeSantis have been at odds over potentially going toe to toe in 2024 for the Republican nomination. Trump has strongly hinted at launching a presidential campaign but early polls have shown an increase in Republicans preferring DeSantis as a potential nominee, posing a major threat to Trump.

Earlier this week, DeSantis split with Trump when he opted to endorse Colorado Senate candidate Joe O’Dea who the president previously referred to as a “stupid person with a big mouth.” Trump said DeSantis’ endorsement was a “BIG MISTAKE” is a message to his TRUTH Social.

Freedom Caucus Chairman Expected to Announce Challenge for House Speaker

Trouble is brewing among House Republicans.

House Freedom Caucus chairman Andy Biggs (R-Ariz.) is reportedly seriously considering mounting a bid to challenge Rep. Kevin McCarthy (R-Calif.) to become the next Speaker of the House.

The expected announcement comes on the heels of Biggs’ openly criticizing McCarthy last week after Republicans experienced fewer-than-anticipated wins on election night. Rep. Biggs told reporters he believes House Republicans should work to enact a more rightward agenda in the next term.

“I think we need to have a real discussion about whether he should be the speaker or not,” Biggs told reporters on Thursday.

“I think that his statement recently that we shouldn’t impeach Secretary Mayorkas indicates that maybe we’re not going to be as aggressive going forward as we should be. I think we need to have a very positive statement of what we’re going to accomplish and do, and I haven’t seen that yet,” he added. “That’s — those are things that I think we should have a very frank discussion internally about, where we’re going to be going forward.”

However, nearly one week after Election Day and neither party has officially won control of the House – although Republicans are projected to win by most major outlets some lawmakers want to push the elections until a majority is declared.

“I think we don’t even know if we’re in the majority, so I think it’s responsible to just look and see where the cards fall right now, and we don’t know,” Rep.-elect George Santos (R-NY) said on Sunday.

Tuesday’s leadership election is slated to be conducted via closed ballot and will only require a plurality of the conference to secure the nomination. McCarthy would need to reach 218 votes during the floor vote in January to win the Speakership.

New York Gubernatorial Candidate Under Investigation

New York Republican gubernatorial nominee Lee Zeldin has been targeted in a new investigation less than two weeks before the midterm elections.

Zeldin is under investigation by the State Board of Elections over allegations that he coordinated with two super PACs supporting his campaign, according to The Hill.

Michael Johnson, the chief enforcement counsel of the New York State Board of Elections, opened a preliminary investigation into Zeldin’s campaign after the allegations emerged.

Johnson is now seeking subpoena authority from the State Board of Elections to compel cooperation with his investigation, according to the Times. 

However, he was stymied when two Republican members of the board unexpectedly missed a business meeting on Tuesday, preventing the board from reaching a quorum to vote on the subpoena issue and likely delaying the issue until after the election, per the Times.

The Albany Times-Union first reported in mid-October that there were several overlaps between Zeldin’s campaign and two super PACs supporting him — Safe Together New York and Save Our State New York.

Days later, the New York State Democratic Party filed a complaint against Zeldin’s campaign over the alleged super PAC. Super PACs are legally allowed to raise and spend unlimited amounts of money to advocate for or against candidates but are barred from coordinating with the candidates they benefit.

Zeldin has been rapidly closing the gap against New York Gov. Kathy Hochul in recent weeks.

Kari Lake Secures Major Endorsement

Kari Lake snagged a key endorsement from a top Republican senator nearly a week after announcing her campaign for Senate.

On Monday, Wyoming Senator John Barrasso’s endorsement comes after Lake formally launched her bid for Sen. Kyrsten Sinema’s (I-Ariz.) seat.

“Kari Lake will shine brightly for Arizona. She is a generational communicator who is giving voice to Arizona citizens,” Barrasso said in a statement. 

“Joe Biden’s policies have crushed Arizona. Arizonans are dealing with record inflation – up 20 percent under the Biden administration. Arizona is also on the front lines of the worst illegal immigration crisis in American history. Nearly 8 million illegal immigrants under Biden, equal to the population of Arizona,” he continued. “The U.S. Senate needs a Senator from Arizona that understands these issues, and will fight hard to solve them.”

Lake thanked Barrasso in a statement, saying, “I am honored by the friendship and endorsement of Senator Barrasso.”

“He is a tested and proven conservative leader who I greatly admire. I look forward to working with Senator Barrasso to get America back on track and fire Chuck Schumer,” she added.

Sen. Barrasso’s endorsement is significant considering some Senator’s hesitation over Lake’s Senate campaign over past comments on election fraud and her links to former President Trump.

According to The Hill, Sen. Steve Daines (R-Mont.), chairman of the Senate GOP campaign arm, has said that he’s had “productive conversations with Kari Lake and her team.”

House Select Committee Officially Subpoenas Donald Trump

The House Select Committee officially issued a subpoena to testify before the panel to former President Trump on Friday morning.

Last week, the committee investigating the Jan. 6th Capitol riot voted unanimously to subpoena during what could be its last public hearing last week.

“As demonstrated in our hearings, we have assembled overwhelming evidence, including from dozens of your former appointees and staff, that you personally orchestrated and oversaw a multi-part effort to overturn the 2020 presidential election and to obstruct the peaceful transition of power,” Chairman Bennie Thompson (D-MS) and Vice Chair Liz Cheney (R-WY) wrote in a joint statement.

Trump responded to the subpoena last and decried the move as a continuation of Democrats’ partisan witch-hunt against him.

“The Unselect Committee has willfully ignored the fact that days before January 6, 2021, I recommended and authorized thousands of troops to be deployed to ensure that there was peace, safety, and security at the Capitol and throughout Washington, D.C. on January 6th because I knew, just based on instinct and what I was hearing, that the crowd coming to listen to my speech, and various others, would be a very big one, far bigger than anyone thought possible,” Trump wrote.

Despite Trump’s ire towards the House panel a source close to the former president insists he “loves the idea of testifying.” The source told Fox News, that if Trump does in fact testify he plans to “talk about how corrupt the election was, how corrupt the committee was, and how Nancy Pelosi did not call up the National Guard that Trump strongly recommended for her to do three days earlier on January 3, 2021.”
