Appeals Court Rules FBI Violated Americans’ Constitutional Rights In Beverly Hills Raid

The U.S. 9th Circuit Court of Appeals found the bureau violated private citizens’ Fourth Amendment rights when it seized contents from hundreds of safe deposit boxes during a 2021 raid on a Beverly Hills business suspected of money laundering.

“This was a resounding victory, not just for our clients, but for the hundreds of people who’ve been stuck in a nightmare for years because of what the FBI did,” Institute for Justice Senior Attorney Rob Frommer, who represented several plaintiffs in the case, told Fox News.

In March 2021, FBI agents searched and seized 1,400 safe deposit boxes without criminal warrants for each. The total the FBI took about $86 million in cash from the boxes in the raid, as well as a trove of jewelry, gold bars and coins, silver and other valuables. In May, the FBI “commenced administrative forfeiture proceedings” against an unspecified number of the boxes, according to court documents filed by the government.

The ruling reversed a 2022 lower court decision siding with the FBI and requires federal officials to destroy any inventory records of the hundreds of box holders not charged with a crime.

Civil asset forfeiture is the process through which the government seizes money or other property believed to be linked to a crime, even if the owner isn’t charged with a crime.

The FBI’s raid on U.S. Private Vaults was part of its investigation into the company, which ultimately shut down and pleaded guilty to conspiracy to launder drug money. 

The warrant only authorized authorities to seize business computers, money counters, and surveillance equipment. The judge also allowed them to seize safety deposit boxes and keys, but specifically wrote that agents should only “inspect the contents of the boxes in an effort to identify their owners … so that they can claim their property,” and that the warrant “does not authorize a criminal search or seizure of the contents of the safety deposit boxes.”

In its decision, the 9th Circuit panel wrote that the government had gone beyond the scope of its warrant and violated its own rules by taking inventory of property that wasn’t the subject of a warrant.

Circuit Judge Milan D. Smith Jr. wrote that it was “particularly troubling” that the government couldn’t explain the limitations to these types of inventory searches and questioned how they differed from the “limitless searches of an individual’s personal belongings” like those seen in colonial America.

One of the plaintiffs in the class-action lawsuit said the win was “incredibly gratifying.”

“Hearing these judges just knock them down a peg and talk through the situation, this extraordinary overreach and an actual breaking of civil rights … it was just really, really gratifying,” she told Fox News

Another plaintiff said while this ruling helped “expose the government’s attempt to steal innocent people’s things,” he doesn’t think it will end civil forfeiture abuse.

“I think this ruling on its own is important, but it won’t stop the FBI’s grasping hand,” he told Fox News. “Yeah, they got their hand slapped just now. But unless there’s real consequences, they’ll just view this as a dry run for the next time.”

Trump Fires Back at Republicans Refusing To Endorse Him

Trump is responding after his former running mate and vice president said last week that he would not endorse Trump’s latest presidential campaign.

Trump spoke with a group of reporters after he cast his ballot in the Florida primary election, which he later won. Trump was asked how he felt about Pence’s recent comments.

“Oh, I couldn’t care less,” Trump told the press corps. “I couldn’t care less. We need patriots. We need strong people in our country. Our country is going downhill very fast, very rapidly.”

He added: “Millions of people coming across the border, coming from jails, from prisons, coming from mental institutions and insane asylum terrorists. We need strong people in this country. We don’t need weak people.”

Pence, who briefly ran for president in the 2024 cycle, announced last week that he would not endorse his former running mate.

“It should come as no surprise that I will not be endorsing Donald Trump this year,” Pence said on “The Story.”

“I’m incredibly proud of the record of our administration. It was a conservative record that made America more prosperous, more secure and saw conservatives appointed to our courts in a more peaceful world,” he added. “What I’m going to spend the rest of this year on is talking about what we should be for. And that is the broad mainstream conservative agenda that’s defined our party and always made America strong and prosperous and free.”

Judge Rules On Trump’s Requests for Immediate Verdict in Fraud Trial

On Wednesday, former President Trump’s legal team asked for an immediate and direct verdict in the Trump Organization civil trial following testimony from ex-attorney Michael Cohen. 

The request came after Cohen admitted during testimony that the former president did not ask him to inflate his finances on a personal financial statement.

During a second day on the stand, Cohen, Trump’s former lawyer and “fixer,” was asked directly whether Trump asked him to inflate his finances on personal financial statements.

“Trump didn’t ask you to inflate the numbers on his personal statement, correct?” Trump attorney Clifford Roberts asked.

“Correct,” Cohen replied.

After Cohen’s response, Roberts spoke with the former president and fellow defense attorneys and told Judge Arthur Engoron he had no further questions.

Roberts then asked for an immediate, direct verdict in the trial in light of Cohen’s testimony.

Judge Engoron immediately said: “denied.”

New York Attorney General Letitia James’ case accuses Trump, his two adult sons, the Trump Organization, and top executives of falsely inflating the values of Trump’s real estate properties and other assets in order to get tax benefits and better loan terms.

James seeks around $250 million in damages, and she wants to bar Trump and his co-defendants from running another business in New York.

Trump responded to the Judge’s ruling in a series of Truth Social posts Wednesday evening.

“The New York State Attorney Generals case against me is DEAD, but the Radical Left Judge REFUSES to end it. He just can’t let it go,” Trump wrote on Truth Social, repeating his frequent attack on the judge in the case.

“Letitia James should focus on Violent Crime, which is out of control. So unfair. I don’t even get a Jury Trial. A blight on the New York State Judicial System,” he continued. “Businesses are watching all over the world, and never coming in, only moving out. The Governor should get involved.”

He added, “Election Interference by my Political Opponent!”

Romney Signals He Will Vote For Democrat In Next Presidential Election

Retiring Utah Senator Mitt Romney signaled we could be open to voting for a Democrat in the next presidential election if it helps keep Donald Trump out of the White House.

“I’d be happy to support virtually any one of the Republicans — maybe not Vivek [Ramaswamy] — but the others that are running would be acceptable to me, and I’d be happy to vote for them,” the retiring senator said Friday in an interview with CBS’s Norah O’Donnell.

“I’d be happy to vote for a number of the Democrats too,” he continued. “It would be an upgrade, in my opinion, from Donald Trump and perhaps also from Joe Biden.”

Romney announced in September that he would not seek reelection, sparking a wave of gloating insults from Trump. Romeny has been one of Trump’s staunchest critics among Senate Republicans, voting twice to impeach him.

“Mitt Romney, sometimes referred to as Pierre Delecto, will not be seeking a second term in the U.S. Senate, where he did not serve with distinction,” Trump wrote in all caps on Truth Social when Romney announced his retirement, referencing the pseudonym Romney used for a private Twitter account.

The Utah Republican’s biographer, McKay Coppins, suggested last month that the animosity between the former president and senator is so heavy that he could even opt to endorse Biden later in the election.

“I would keep an eye out for whether Romney does something like endorse Joe Biden late in the election,” Coppins said in an October interview with “The Press Box” podcast. “I mean, I have no idea, I haven’t talked to him about this. I would not be shocked if he did.”

Pro-Trump Candidate Beats Moderate Dem in Utah Special Election

Republican Celeste Maloy beat state Sen. Kathleen Riebe, a self-described moderate, to win Utah’s special election Tuesday night.

Maloy, a pro-Trump candidate, filled the last remaining seat in the U.S. House of Representatives with her victory in Utah’s 2nd congressional district.

As a candidate, Maloy touted her roots growing up in rural southern Utah, of which the district covers a vast portion, and has leaned into her support of former President Donald Trump, arguing the numerous ongoing prosecutions against him are politically motivated.

“It’s exciting that we’re going to have somebody come out of this primary that represents rural and southern Utah. I think it’s time for that, and everybody’s ready for it,” Maloy said following her primary win.

However, Riebe has argued the race is a pickup opportunity for Democrats, and has leaned on her experience as a school teacher while making the case that people in the district “are ready for a change.”

In an interview with Deseret News in August, Riebe expressed concern over the nation’s rising debt, and vowed to join the fiscally conservative Blue Dog Coalition if elected.

“Coming to a very rational decision and having very moderate ideas, I think that is what serves us best,” she told the outlet.

DeSantis Dismisses Trump Running Mate Speculation

Ron DeSantis has his eyes on the prize.

The Florida governor and White House contender said he is not interested in becoming Donald Trump’s running mate if given the chance.

“I don’t think so. I’m not a No. 2 guy,” DeSantis said on the “Wisconsin Right Now” radio show, NBC News reported.

DeSantis said he would opt to stay in his governorship over joining Trump’s ticket, adding that the vice presidency “doesn’t really have any authority.”

When asked whom he would consider signing on as a running mate, the Sunshine State governor said “it’s a little bit presumptuous to be doing that at this stage,” adding that he’s focused on winning the early primaries before delving deep into his search for vice president.

The Florida governor is trailing Trump in the 2024 GOP primary race by nearly 30 points nationally, according to a FiveThirtyEight poll.

Recently, a pro-DeSantis spokesperson told Mediaite he has serious concerns about the Florida Governor’s ability to take on Trump.

“Right now in national polling we are way behind, I’ll be the first to admit that,” said Cortes. “I believe in being blunt and honest. It’s an uphill battle but clearly Donald Trump is the runaway frontrunner.”

He added that DeSantis’ campaign was the “clear underdog,” and added that in the first four primary states, “which matter tremendously, polls are a lot tighter, we are still clearly down. We’re down double digits, we have work to do.”

FBI Refuses to Hand Over Docs Linked to Alleged Biden Crime Ring

The Federal Bureau of Investigation (FBI) has refused to turn over subpoenaed documents related to the House Oversight Committee’s investigation into the Biden family’s business dealings.

On Monday, the agency refused to provide the document in a private meeting with the House Oversight and Accountability Committee, according to Fox News. The unclassified FD-1023 document details criminal allegations of a pay-to-play scheme related to the Biden family’s business dealings, according to a whistleblower at the agency who spoke with Sen. Chuck Grassley (R-Iowa).

Rep. James Comer (R-Ky.) who chairs the Oversight Committee, issued the subpoena to the FBI, which previously failed to provide the document by a May 10 deadline. Comer has threatened to hold the FBI’s budget “hostage” until the agency turns over the document.

“They don’t respect anyone in Congress,” Comer said Monday on Fox News. “They’ve been able to get away with this for a long time. The media continues to turn a blind eye. The Senate Republicans continue to fund the FBI. Why would you change your business model when you’re getting everything you want?”

House Speaker Kevin McCarthy, R-Calif., said he had a call with FBI Director Christopher Wray on Friday and is confident the agency will eventually provide the document.

“I explained to the director that we will do everything in our power, and we have the jurisdiction over the FBI, and we have the right to see this document,” McCarthy said Sunday on Fox News. “I believe after this call, we will get this document.”

Comer said Monday he has spoken with McCarthy about holding Wray under contempt if he does not comply.

Trump Says He’s Ruled Out Some Potential VP Candidates

The list is getting even shorter…

On Wednesday, former President Donald Trump said that he’s eliminated some potential picks for vice president from his list.

During an interview with Trump on his show Greg Kelly Reports, Newsmax host Greg Kelly questioned, “Vice president. Are you any closer? Have you ruled anybody out?”

Trump replied:

Yeah, I probably have a couple of people that you may know very well. Some people that I didn’t think behaved properly. Yeah, I think I’ve ruled some people out, but I’ve ruled a lot of people in. We have a lot of great people in the Republican Party, and they’ll do a terrific job, I think, but certainly I have people that I wouldn’t want as a vice president.

While Trump did not elaborate on who exactly had been ruled out.

Last month, Trump confirmed a short list of names he is considering asking to become his running mate in the coming months.

The list included three former GOP candidates, Sen. Tim Scott (R-S.C.), entrepreneur Vivek Ramaswamy and Gov. Ron DeSantis (R-Fla.). He also confirmed that Rep. Byron Donalds (R-Fla.), Gov. Kristi Noem (R-S.D.) and former Hawaii Rep. Tulsi Gabbard, who served in Congress as a Democrat but has since shifted to more conservative views.

After Kelly asked Trump whether a “formal process” was currently underway, Trump said, “No, it’s a formal process that’s in my brain. It’s like I look at the same people that everybody else is looking at.”

He continued:

We’ve had some really great people. I think we have really great people that want it. People have expressed, I mean not their interest, they’ve expressed like, “I would love to be vice president.” Who wouldn’t? If you’re a politician, who wouldn’t want it? But you know, I get a kick out of watching the fake news media say, “Nobody wants to work with him. Nobody wants to be vice president. Nobody wants to be secretary of state.” Everybody wants to be in these positions.

“There’s not a person in politics that doesn’t want it, and that includes Democrats. If I wanted, I’d have a Democrat, I’d have a liberal, I’d have anybody I want.”

Trump concluded, “Really, if you want to stay within a certain boundary, the press covers the people that are being thought about. It’s unusual that you’d pick somebody totally out of that, and there are 15 people they talk about, and that list grows every day. But we’re gonna pick somebody that’s really good, really conservative, loves law and order, low taxes, low interest rates, borders.”

Judge Knocks Attorney Over 2020 Election

On Wednesday, a California judge recommended disbarring pro-Trump attorney John Eastman for his role in former President Trump’s efforts to overturn the 2020 election.

According to The Hill, State Bar Judge Yvette Roland found John Eastman culpable on 10 of the 11 counts filed by the California State Bar last year. The state bar sought to strip Eastman’s license to practice law in the state due to his “false and misleading statements” about purported election fraud and his role in “provoking” the Jan. 6, 2021, Capitol riot.

“In view of the circumstances surrounding Eastman’s misconduct and balancing the aggravation and mitigation, the court recommends that Eastman be disbarred,” Roland wrote in a 128-page decision.

The judge also recommended that Eastman be ordered to pay $10,000 in sanctions to the State Bar of California Client Security Fund.

Roland wrote in her decision that Eastman showed an unwillingness to admit to “any ethical lapses” in his behavior.

“This lack of remorse and accountability presents a significant risk that Eastman may engage in further unethical conduct, compounding the threat to the public,” the judge wrote.

Eastman led the legal strategy attempting to change the election results in several key 2020 states, including by using slates of alternate electors to swing the election’s outcome in Trump’s favor. The plan also relied on then-Vice President Mike Pence throwing out the real electors for the “fake” ones.

Hunter Biden Lawyers Seek To Dismiss Delaware Gun Charges

Hunter Biden’s legal team has filed a motion to dismiss the indictment against him over gun charges in Delaware.

Earlier this year, special counsel David Weiss charged Hunter Biden with making a false statement in the purchase of a firearm; making a false statement related to information required to be kept by a federal firearms licensed dealer; and one count of possession of a firearm by a person who is an unlawful user of or addicted to a controlled substance. 

The president’s son pleaded not guilty to all counts in October before a sweetheart plea deal fell through.

Biden’s lawyers are attempting to have the indictment dismissed by saying it “violates” the collapsed plea agreement and maintain it is “still in effect” between the president’s son and federal prosecutors.

“The Indictment against Mr. Biden must be dismissed because it violates a Diversion Agreement that is in effect between Mr. Biden and the prosecution,” Lowell argued in the filing. “In exchange for Mr. Biden giving up various rights—including his Fifth Amendment right to remain silent by agreeing to the Statement of Facts drafted by the prosecution and numerous restrictions on his liberty—the prosecution agreed to provide him immunity for any offense concerning his purchase of a firearm (among other offenses).” 

Citing the initial agreement, which Republicans have billed as a “sweetheart plea deal,” Lowell said prosecutors, in July, said they could not bring firearms charges “based on the firearm identified in the factual statement to the Diversion Agreement.” 

“Nevertheless, the prosecution did just that, by subsequently bringing this Indictment charging Mr. Biden with three felony firearm offenses, which all relate to the firearm identified in the Diversion Agreement’s factual statement,” Lowell continued Monday. “Because Mr. Biden gave up valuable rights as part of this contract, in exchange for the prosecution’s promise not to prosecute him, such promise must be fulfilled.”

Last week, Biden was also indicted on tax charges in California.

CNN reported that Hunter was hit with nine counts on charges that include failure to file and pay taxes; evasion of assessment and false or fraudulent tax return.

Biden is facing up to 17 years in prison for his crimes.
